| | 奉美艳申请再审称：（一）一、二审裁定认定的基本事实缺乏证据证明。其系对（2011）青执字第25号裁定（以下简称25号执行案件）所涉及的华丰银行、胶南支行诉兆基公司借款合同纠纷案提出执行异议和执行异议之诉，原审法院错误的将涉案案件认定为（2010）青执字第86号执行案件（以下简称86号执行案件），属于对案件事实的认定错误。以错误认定的涉案案件已执行终结为由，在未对奉美艳提交的能证明其为涉案房屋所有权人的证据进行审查的情形下，认为华运公司对涉案房屋享有所有权，属于认定事实缺乏证据支持。（二）二审裁定适用法律确有错误。按照《中华人民共和国民事诉讼法》（以下简称民诉法）第二百二十七条的规定，奉美艳对执行异议裁定享有提起诉讼的权利。一审法院既然已经就奉美艳的执行异议立案受理，却又在奉美艳依法针对该驳回异议裁定提起诉讼后，又以涉案事项不属于民事诉讼审理范围为由，驳回奉美艳的起诉，违反法律规定。（三）二审裁定违法。二审法院未将案件合议庭人员组成情况告知奉美艳，从而剥夺了奉美艳对合议庭组成人员的知情权及申请回避的权利。（四）二审从未询问过奉美艳，剥夺了其陈述、辩论的权利。奉美艳依照民诉法第二百条第二项、第六项、第七项、第九项的规定，申请再审，请求撤销一、二审裁定，改判支持其诉讼请求。 |
