To implement the national shipbuilding industrial restructuring and revitalization program, broaden the financing channels for shipbuilding enterprises, and regulate the registration of mortgages over ships under construction, the Maritime Safety Administration of the People's Republic of China (MSA) formulated the Interim Measures for the Registration of Mortgages over Ships under Construction, which are hereby issued to you for compliance and implementation. If you encounter any problem or difficulty in the implementation thereof, please timely report it to the MSA. | |

| Article 1 These Measures are formulated according to the Real Right Law of the People's Republic of China, the Guarantee Law of the People's Republic of China, the Maritime Code of the People's Republic of China, the Regulation of the People's Republic of China on the Registration of Ships and other relevant provisions to implement the national shipbuilding industrial restructuring and revitalization program, broaden the financing channels for shipbuilding enterprises, and regulate the registration of mortgages over ships under construction. | | 第一条 为落实国家船舶工业调整振兴规划，拓宽船舶建造企业融资渠道，规范建造中船舶抵押权登记行为，依据《中华人民共和国物权法》、《中华人民共和国担保法》、《中华人民共和国海商法》、《中华人民共和国船舶登记条例》等有关规定，制定本办法。 |

| Article 2 These Measures shall apply to the handling of the registration of mortgages over ships under construction by ship registration authorities. | | 第二条 本办法适用于船舶登记机关办理建造中船舶抵押权登记的行为。 |
| |
|
| Article 3 When creating a mortgage over a ship under construction, the mortgagor and the mortgagee shall go through the registration of mortgage at the authorized ship registration authority of the place where the domicile of the shipbuilding enterprise is located. | | 第三条 对建造中船舶设置抵押时，抵押人和抵押权人应当到船舶建造企业住所地经授权的船舶登记机关办理抵押权登记。 |

| Article 4 To apply for going through the registration of mortgage over a ship under construction, the following conditions shall be met: | | 第四条 申请办理建造中船舶抵押权登记应当满足以下条件： |
| |
|
| (1) The mortgagor shall be a shipbuilding enterprise meeting the qualification requirements of the state or the relevant competent department; | | （一）抵押人为满足国家或有关主管部门资质要求的船舶建造企业； |
| |
|
| (2) The mortgagee shall be a financial institution capable of granting loans; | | （二）抵押权人为具备发放贷款资格的金融机构； |
| |
|
| (3) The mortgagor shall have independent ownership of the mortgaged ship; | | （三）抵押人独立拥有被抵押船舶的所有权； |
| |
|
| (4) If a ship under construction that is taken as property under mortgage is built through the hull-block construction method, at least one block must be completed and the construction must be ongoing; if the ship is built through the integral shipbuilding method, the keel must have been laid and the construction must be ongoing; | | （四）作为抵押物的建造中船舶，如为分段建造的，应该已经完成至少一个以上的船舶分段并处于建造阶段；如为整体建造的，应该已经安放龙骨并处于建造阶段； |
| |
|
| (5) The value of the ship under construction that is taken as property under mortgage shall be assessed by a qualified asset evaluation institution and shall be confirmed in writing by the mortgagor and the mortgagee; | | （五）作为抵押物的建造中船舶价值由具备资产评估资格的资产评估机构评估，并经抵押人、抵押权人书面确认； |

|
| (6) The value of the obligation secured by the mortgage of the ship under construction shall not exceed the assessed value of the ship at the time of application for registration of mortgage; and | | （六）建造中船舶抵押担保的债权不得超过其申请抵押权登记时的评估价值； |
| |
|
(7) There are no other circumstances that the laws or regulations prevent the creation of the mortgage.
