In order to regulate the administration of the examination and approval of changes in the government procurement methods of central government agencies and strengthen the government procurement administration of central government agencies, the Ministry of Finance has formulated the Interim Administrative Measures for the Examination and Approval of Changes in the Government Procurement Methods of Central Government Agencies according to the Law of the People's Republic of China on Government Procurement. These Measures are hereby issued to you for your compliance and implementation.
 
为了规范中央单位变更政府采购方式审批管理工作,加强中央单位政府采购管理,根据《中华人民共和国政府采购法》,财政部制定了《中央单位变更政府采购方式审批管理暂行办法》。现印发给你们,请遵照执行。

Article 1 These Measures are formulated according to the Law of the People's Republic of China on Government Procurement (hereinafter referred to as “Government Procurement Law”) for the purposes of regulating the administration of examination and approval of changes in the government procurement methods of central government agencies and strengthening the government procurement administration of central government agencies.   第一条 为了规范中央单位变更政府采购方式审批管理工作,加强中央单位政府采购管理,根据《中华人民共和国政府采购法》(以下简称政府采购法),制定本办法。

 
Article 2 These Measures shall apply to the applications made by central government agencies for changes in the government procurement methods, as well as the examination and approval made by the Ministry of Finance of such applications.   第二条 中央单位申请变更政府采购方式和财政部审批变更政府采购方式申请的,适用本办法。

The “central government agencies” as mentioned in these Measures shall include the first-class, second-class and grassroots Central budget units.
 
本办法所称中央单位包括中央一级预算单位、中央二级预算单位和中央基层预算单位。

 
Article 3 Where the goods or services to be procured by a central government agency reach the amount standard for public bidding, the procurement shall be made in the method of public bidding. Where any procurement method other than public bidding needs to be used under special circumstances, the procuring entity shall, prior to the start of procurement activities, make an application for changes in the government procurement method to the Ministry of Finance for examination and approval according to the requirements set forth by the Ministry of Finance.   第三条 中央单位采购达到公开招标数额标准的货物或者服务的,应当采用公开招标方式采购。因特殊情况需要采用公开招标以外其他采购方式的,采购人应当在采购活动开始前,按照财政部规定要求将变更政府采购方式申请报财政部审批。

The “procurement method other than public bidding” as mentioned in these Measures refers to the selected bidding, competitive negotiation, single-source procurement, inquiry for quotation or any other procurement method as recognized by the Ministry of Finance according to actualities.
 
本办法所称公开招标以外其他采购方式,是指邀请招标、竞争性谈判、单一来源采购、询价以及财政部根据实际情况认定的其他采购方式。

 
Article 4 An application for changes in the government procurement method shall be made to the Ministry of Finance by a first-class Central budget unit.   第四条 变更政府采购方式申请应当由中央一级预算单位向财政部提出。

A first-class Central budget unit shall be responsible for the authenticity of its application materials. The Ministry of Finance shall examine and approve an application according to the Government Procurement Law and based on the application elements set forth in these Measures.
