The transport departments (bureaus or committees), development and reform commissions, and price bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government; the Yangtze River Navigation Authority and the Pearl River Navigation Authority of the Ministry of Transport; and all maritime safety administrations directly under the Ministry of Transport: 各省、自治区、直辖市交通运输厅(局、委)、发展改革委、物价局,交通运输部长江航务管理局、珠江航务管理局,交通运输部各直属海事局:
For purposes of implementing the work arrangements made at the Central Economic Work Conference for further reducing logistics costs and made by the State Council for optimizing the business environment at ports, further reviewing and regulating port business service charges, and effectively ensuring that enterprises feel more satisfied through reduction of their burden, in accordance with the Law of the People's Republic of China on Ports, the Price Law of the People's Republic of China and the Catalogue of Pricing by the Central Government, the Ministry of Transport and the National Development and Reform Commission have revised the Measures for Calculation and Collection of Harbor Charges, which are hereby issued to you for your compliance and implementation. You are hereby notified of the relevant matters as follows: 为贯彻落实中央经济工作会议关于进一步降低物流成本和国务院关于优化口岸营商环境的工作部署,进一步清理规范港口经营服务性收费,切实增强企业减负获得感,依据《中华人民共和国港口法》《中华人民共和国价格法》《中央定价目录》,交通运输部会同国家发展改革委对《港口收费计费办法》进行了修订,现印发给你们,请遵照执行。有关事项通知如下:
I. Reducing charging rates of some government-priced fees   一、降低部分政府定价收费标准
The charging rates of harbor dues on cargo, port facility security fees, pilotage dues (cost of shifting), and towage for vessels engaged in domestic voyages will reduce by 15%, 20%, 10%, and 5%, respectively. The owners of domestic trade vessels of 80 meters or less (excluding chemical tankers and liquefied gas tankers) entering and leaving coastal ports and domestic trade vessels of 150 meters or less entering or leaving ports along the trunk waterways of the Yangtze River shall, based on actual circumstances, determine whether to use a tugboat on the premise of ensuring safety. 将货物港务费、港口设施保安费、引航(移泊)费、航行国内航线船舶拖轮费的收费标准分别降低15%、20%、10%和5%。进出沿海港口的80米及以下内贸船舶(化学品船、液化气体船除外)、进出长江干线港口的150米及以下内贸船舶,由船方在确保安全的前提下,根据实际情况决定是否使用拖轮。
II. Consolidating charge items   二、合并收费项目
Under the principle of “reduction and consolidation of charging items,” storage fees and warehouse or container yard usage fees will be consolidated into and named as warehouse or container yard usage fees; service fees for water supply (materials), service fees for oil (gas) supply and service fees for power supply into supply service fees of vessels; service fees for receiving and treating solid waste and service fees for receiving and treating sewage with oil into service fees for receiving and treating vessel pollutants. 按照“减项、并项”的原则,将堆存保管费、库场使用费合并名称为库场使用费;将供水(物料)服务费、供油(气)服务费、供电服务费合并名称为船舶供应服务费;将垃圾接收处理服务费、污油水接收处理服务费合并名称为船舶污染物接收处理服务费。
III. Regulating the collection of fees   三、规范收费行为
Port operators, pilotage institutions and other entities shall strictly implement government pricing, effectively implement the list of port business service charges and the publication system thereof, and adjust the names of charging items and the charging rates as publicized according to this Notice in a timely manner. Relevant agencies which collect and pay for harbor dues on cargo, port facility security fees and other government-priced charges on behalf of other businesses shall be prohibited from raising charges, increasing charging rates or imposing compulsory charges in disguise by various means. No oil containment boom service provider shall compulsorily provide oil containment boom services to those vessels loading or unloading non-persistent oil. No oil containment boom service provider, tugboat operator or any other entity shall collect fees beyond the scope or the charging rates. 港口经营人、引航机构等单位要严格执行政府定价,落实港口经营服务性收费目录清单和公示制度,根据本通知及时调整对外公示的收费项目名称和收费标准。相关代理企业代收代付货物港务费、港口设施保安费等政府定价收费,不得加价收费。不得通过各种手段变相提高收费标准、强制收费。围油栏服务单位不得对装卸非持久性油类的船舶强制提供围油栏服务。围油栏服务单位、拖轮经营人等不得超范围、超标准收费。
Except for pilotage services, the technical service fees for piloting mobile offshore platforms to sail on Chinese waters shall be subject to market-regulated prices, and pilotage service providers shall determine the specific charging rates with their clients through consultation. 引航服务以外引领海上移动式平台在我国水域航行的技术服务费实行市场调节价,由引领服务单位与委托方协商确定具体收费标准。
IV. Ensuring that all policies are effectively implemented   四、确保各项政策落实到位
The local transport administrative departments (port administrative departments) and pricing departments at all levels shall strengthen policy publicity, and circulate the requirements of this Notice to relevant operators and entities in a timely and accurate manner; strengthen supervision over and guidance to the implementation of policies, supervise port operators and relevant entities' self-examination and self-correction, keep channels for reporting unimpeded, publish hotlines for reporting, handle the problems reflected in a timely manner, and encourage to inquire and complain about relevant issues by calling telephone at 12328. They shall strengthen coordination with relevant departments, establish an interaction mechanism, conduct joint law enforcement, and ramp up punishment on such acts as the collection of fees in violation of regulations. A competition mechanism shall be further introduced in port tally services, tug services, oil containment boom services and other market business activities. 地方各级交通运输(港口行政)管理部门和价格主管部门要加强政策宣传,将本通知要求及时、准确传达到相关经营人和单位。要加强政策落实情况督导,督促港口经营人和相关单位开展自查自纠,畅通举报渠道,公布举报电话,及时处理反映的问题,鼓励使用12328电话咨询和投诉相关问题。要与相关部门加强协调,建立联动机制,开展联合执法,加大对违规收费等行为的处罚力度。港口理货、拖轮、围油栏服务等市场经营要进一步引入竞争机制。
This Notice shall come into force on April 1, 2019 and be valid for a period of five years. The Ministry of Transport and the National Development and Reform Commission shall improve relevant policies at appropriate time according to the implementation of policies and market changes. The Notice of Matters Concerning the Collection of Port Facility Security Fees (No. 238 [2006], Ministry of Communications) issued by the former the Ministry of Communications and the Notice by the Ministry of Transport and the National Development and Reform Commission of Issuing the Measures for Calculation and Collection of Harbor Charges (No. 104 [2017], Ministry of Transport) shall be repealed concurrently. For any discrepancy between the provisions on port business service charges issued previously and this Notice, this Notice shall prevail. 本通知自2019年4月1日起执行,有效期5年。交通运输部、国家发展改革委将根据政策执行和市场变化情况适时完善相关政策。原交通部《关于收取港口设施保安费有关事宜的通知》(交水发〔2006〕238号)和《交通运输部 国家发展改革委关于印发<港口收费计费办法>的通知》(交水发〔2017〕104号)同时废止。此前发布的有关港口经营服务性收费的规定与本通知不符的,以本通知为准。

Measures for Calculation and Collection of Harbor Charges 港口收费计费办法
Chapter I General Provisions 

第一章 总则

Article 1 For purposes of regulating port business service charges, improving the port-related price forming mechanism, maintain the lawful rights and interests of all parties operating, using and managing ports, and promoting the sustained and healthy development of port industry, these Measures are formulated according to the overall arrangements for comprehensively deepening the reform at the Third Plenary Session of the 18th Central Committee of the Communist Party of China in accordance with the Law of the People's Republic of China on Ports, the Price Law of the People's Republic of China, the Catalogue of Pricing by the Central Government, the Central Catalogue of Enterprise-Related Business Service Charges, the Central Catalogue of Enterprise-Related Business Service Charges in Imports and Exports, the Provisions on the Administration of Port Operations and other documents.   第一条 按照党的十八届三中全会关于全面深化改革的总体部署,为规范港口经营服务性收费行为,完善港口价格形成机制,维护港口经营、使用、管理各方的合法权益,促进港口事业持续健康发展,根据《中华人民共和国港口法》《中华人民共和国价格法》《中央定价目录》《中央涉企经营服务收费目录清单》《中央涉企进出口环节经营服务收费目录清单》和《港口经营管理规定》等,制定本办法。
Article 2 These Measures shall apply to the port business service charges calculated and collected by port operators, pilotage institutions and other entities from the owners of vessels or cargo owners or their agents, for the provision of services in terms of entry and exit of vessels, berthing, mooring, embarkation and disembarkation of passengers, loading, and unloading of cargo, barges, storage and port security, at main coastal ports and ports along the trunk waterways of the Yangtze River as well as all other ports that are open to foreign vessels in the People's Republic of China.   第二条 中华人民共和国沿海、长江干线主要港口及其他所有对外开放港口,提供船舶进出、停泊、靠泊,旅客上下,货物装卸、驳运、储存和港口保安等服务,由港口经营人和引航机构等单位向船方、货方或其代理人等计收港口经营服务性费用,适用于本办法。
The relevant provisions of these Measures on vessels engaged in international voyages and cargo and containers imported or exported for international trade shall apply, mutatis mutandis, harbor charges for the transport between mainland ports and Hong Kong, Macao or Taiwan. 各港与香港、澳门、台湾之间运输的港口收费,比照本办法有关航行国际航线船舶和外贸进出口货物及集装箱的有关规定执行。
The relevant provisions of these Measures may apply, mutatis mutandis, to the measures for the calculation and collection of charges at other ports, which shall be formulated according to the pricing authority and the specific applicable scope set forth in the catalogues of pricing issued by local governments. 其他港口的收费计费办法,依据地方定价目录规定的定价权限和具体适用范围制定,可参照本办法有关规定执行。
The measures for the calculation and collection of pilotage dues (cost of shifting) on vessels along the trunk waterways of the Yangtze River. 长江干线船舶引航(移泊)的收费计费办法另行规定。
Article 3 Harbor charges include business service charges subject to government-fixed pricing, government-guided pricing, and market-regulated prices. Particularly, harbor charges subject to government-fixed pricing include harbor dues on cargo and port facility security fees; harbor charges subject to government-guided pricing include pilotage dues (cost of shifting), towage, berthing fees and oil containment boom usage fees; harbor charges subject to market-regulated prices include terminal handing charges (THC), warehouse or container yard usage fees, supply service fees of vessels, service fees for receiving and treating vessel pollutants, and tally service fees.   第三条 港口收费包括实行政府定价、政府指导价和市场调节价的经营服务性收费,其中实行政府定价的港口收费包括货物港务费、港口设施保安费;实行政府指导价的港口收费包括引航(移泊)费、拖轮费、停泊费和围油栏使用费;实行市场调节价的港口收费包括港口作业包干费、库场使用费、船舶供应服务费、船舶污染物接收处理服务费、理货服务费。
The said charging items shall be calculated and collected separately by items. No port operator or pilotage institution shall set up any other port-related charging item beyond the above scope. 上述收费项目均应单独设项计收,港口经营人和引航机构不得超出以上范围另行设立港口收费项目。
Port operators and pilotage institutions shall establish a system for the list of charging items, actively publicize charging items, corresponding service contents and charging rates by public notice columns, bulletin boards, price lists (books), electronic display screens, electronic touch screens or otherwise, and accept public scrutiny. The public notice columns for charges (including bulletin boards, electronic display screens, electronic touch screens, etc.) shall be permanently set up at the charging places and other places that are convenient for the reading of the public. The columns shall be placed separately as is possible at the conspicuous places, with correct fonts that measure up to the standards. 港口经营人和引航机构要建立收费目录清单制度,采取公示栏、公示牌、价目表(册)或电子显示屏、电子触摸屏等方式,主动公示收费项目、对应服务内容和收费标准,接受社会监督。收费公示栏(含公示牌、电子显示屏、电子触摸屏等)要长期固定设置在收费场所以及港区内方便阅读的地方,尽可能独立置放,位置明显,字体端正规范。
Article 4 Harbor charges subject to government-fixed pricing must be calculated and collected at charging rates provided in these Measures; harbor charges subject to government-guided pricing shall be capped at charging rates provided in these Measures, and port operators and pilotage institutions may independently develop specific charging rates within the scope of charging items not exceeding the upper limit; for harbor charges subject to market-regulated prices, port operators shall independently develop charging items based on market supply and demand and competition as well as their overheads and service contents.   第四条 实行政府定价的港口收费必须按照本办法规定的收费标准计收;实行政府指导价的港口收费应以本办法规定的收费标准为上限,港口经营人和引航机构可在不超过上限收费标准的范围内自主制定具体收费标准;实行市场调节价的港口收费由港口经营人根据市场供求和竞争状况、生产经营成本和服务内容自主制定收费标准。
The rates of harbor charges subject to government-fixed pricing shall be determined according to the rates provided in these Measures; The rates of harbor charges subject to government-guided pricing shall be determined on the basis of the sum of base rates, surcharges, and preferential charges prescribed in these Measures. 实行政府定价的港口收费标准按本办法规定的费率确定;实行政府指导价的港口收费标准按本办法规定的基准费率、附加收费、优惠收费合计确定。
The port administrative department in the place where a port is located shall report its specific charging items for pilotage dues (cost of shifting) to the provincial transport and pricing departments, and then pilotage institutions shall announce them to the public and apply them. 引航(移泊)费的具体收费标准,应经港口所在地港口行政管理部门抄报省级交通运输、价格主管部门,由引航机构对外公布执行。
Article 5 The owner of a vessel or the cargo owner or the agent thereof shall, no later than the date on which the vessel arrives at a port, submit the written information on the payer to the port operator or manager or the pilotage institution. Where the import or export manifests and relevant information provided by the owner of the vessel or the agent thereof are erroneous or need to be modified, the port operator or manager or the pilotage institution shall be notified in writing before cargo is discharged or loaded from or to the vessel.   第五条 船方、货方或其代理人应不迟于船舶到港的当天,将有关付费人的书面资料提交港口经营人、管理人或引航机构。船方或其代理人提供的进出口舱单及有关资料有误或需要变更的,应在卸船或装船前书面通知港口经营人、管理人或引航机构。
Article 6 The chargeable unit and the method of rounding shall comply with the following provisions:   第六条 港口收费计费单位和进整办法应符合下列规定:
1. Charges shall be calculated in RMB as the chargeable unit. The mantissa of each charge of each bill of lading or delivery order (D/O) shall be rounded, and the minimum charge for each chargeable bill or order is one yuan. (一)费用计算以人民币元为计费单位。每一提货单或装货单每项费用的尾数按四舍五入进整,每一计费单的最低收费额为1元。
2. For vessels, the chargeable unit shall be freight ton. If a vessel is able to calculated on the basis of its net tonnage, one net ton is one freight ton; without net tonnage, it shall be calculated on the basis of its gross tonnage; if neither net tonnage nor gross tonnage is not available, it shall be calculated on the basis of deadweight tonnage; or if net tonnage, gross tonnage or deadweight tonnage is not available, it shall be calculated on the basis of displacement, all of which shall be charged at the charging rates of freight tons. Tugboats are calculated by horsepower, with one horsepower as one freight ton. Wooden or bamboo rafts, floaters and the like are calculated by volume, with one cubic meter as one freight ton. The chargeable weight of less than one freight ton shall be rounded to one freight ton. (二)船舶以计费吨为计费单位,按净吨计算,1净吨为1计费吨,无净吨的按总吨计,既无净吨也无总吨的按载重吨计,既无净吨也无总吨和载重吨的按排水量计,并均按计费吨的收费标准计费。拖轮按马力计算,1马力为1计费吨。木竹排、水上浮物等按体积计算,1立方米为1计费吨。不满1计费吨的按1计费吨计。
3. For time, the chargeable unit is day or hour. In the case that the chargeable unit is day, the time shall be calculated by calendar day, and the time of less than one day shall be rounded up to one day; in the case that the chargeable unit is hour, the time of less than one hour shall be rounded to one hour; for the mantissa exceeding one hour, if it is less than half an hour, it shall be charged by half an hour, if it exceeds half an hour, it shall be charged by one hour, except as otherwise prescribed. (三)时间以日或小时为计费单位。以日为计费单位的,按日历日计,不满1日按1日计;以小时为计费单位的,不满1小时按1小时计,超过1小时的尾数,不满半小时按0.5小时计,超过半小时的按1小时计。另有规定的除外。
4. In the case that the chargeable unit is kilometer, the distance of less than one nautical mile or one kilometer shall be rounded to one nautical mile or one kilometer. (四)距离以海里或千米为计费单位,不满1海里或1千米的按1海里或1千米计。
5. In the case that the chargeable unit is square meter, the area of less than one square meter shall be rounded to one square meter. (五)面积以平方米为计费单位,不满1平方米的按1平方米计。
6. Where the chargeable tons of cargo include weight tons (W) and measurement tons (M), harbor charges shall be calculated on the basis of either weight tons or measurement tons, whichever is the greater. Weight tons are the rough weight of cargo, with 1,000 kilograms as one weight ton; measurement tons are the volume of cargo subject to “maximum measurement,” with one cubic meter (CBM) as one measurement ton. The weight of special cargo shall be converted according to Schedule 1 (Conversion Table for Weight of Special Cargo). When the actual weight is greater than the converted weight, the converted weight shall apply. (六)货物以重量吨或体积吨为计费单位,既有重量吨又有体积吨的,择大计费。重量吨为货物的毛重,以1000千克为1重量吨;体积吨为货物“满尺丈量”的体积,以1立方米为1体积吨。特殊货物重量按表1(特殊货物重量换算表)进行换算,实重大于换算重量时,按换算重量计算。
7. The weight or volume of each item of cargo in each bill of lading or delivery order (D/O) shall be calculated at a minimum charge of one weight ton or one measurement ton, and the mantissa exceeding one weight ton or one measurement tone shall be rounded to the nearest 0.01. The cargo of the same grade in each chargeable bill or order shall be added and then rounded. (七)每一提货单或装货单每项货物的重量或体积,最低以1重量吨或1体积吨计算;超过1重量吨或1体积吨的,尾数按0.01进整。每一计费单同一等级的货物相加进整。
8. For containers, the chargeable unit shall be container (called a twenty-foot or forty-foot equivalent unit). For the empty containers that may be enfolded, if four or less containers are piled up together, the chargeable unit shall be one container of the corresponding standard weight, except as otherwise prescribed. (八)集装箱以箱(20英尺或40英尺)为计费单位。可折叠的空箱,4箱及4箱以下摞放在一起的,按1箱相应标准的重箱计费。另有规定的除外。
Article 7 The weight or volume of cargo shall be on the basis of that as enumerated in the bill of lading, the delivery order (D/O) or the contract of cargo operations at a port. The port operator or manager may verify the weight or volume of cargo, and if the weight or volume of cargo enumerated in the bill of lading, the delivery order (D/O) or the contract of cargo operations at a port is inconsistent with that verified, the actual verified result shall be the basis for charging.   第七条 货物的重量或体积,以提货单、装货单或港口货物作业合同上所列为准。港口经营人、管理人可对货物的重量或体积进行核查,提货单、装货单或港口货物作业合同上所列重量或体积与核查不符的,以实际核查结果作为计费依据。
Article 8 Pilotage dues (cost of shifting), towage, berthing fees and oil containment boom usage fees shall be calculated and collected with an upper limit of charging rates provided in these Measures, except for harbor dues on cargo and port facility security fees.   第八条 除货物港务费、港口设施保安费外,引航(移泊)费、拖轮费、停泊费和围油栏使用费均应以本办法规定的收费标准为上限计收费用。
Chapter II Harbor Dues on Cargo 

第二章 货物港务费

Article 9 For the cargo and containers loaded or discharged through a port, the entities responsible for maintaining and managing the breakwaters, waterways, anchorages and other infrastructure of the port shall collect harbor dues on cargo from the cargo owners or their agents on behalf of the port.
