各省、自治区、直辖市人民检察院，新疆生产建设兵团人民检察院：
《最高人民检察院关于加强对监外执行罪犯脱管、漏管检察监督的意见》已经2007年3月26日最高人民检察院第十届检察委员会第七十四次会议通过，现印发给你们，请结合实际认真贯彻执行。

最高人民检察院关于加强对监外执行罪犯脱管、漏管检察监督的意见
（2007年3月26日最高人民检察院第十届检察委员会第七十四次会议通过）
为防止和纠正被管制、剥夺政治权利、缓刑、假释、暂予监外执行罪犯（以下统称“监外执行罪犯”）脱管、漏管问题，建立健全监外执行检察监督机制，保障刑罚的依法有效执行，根据《中华人民共和国刑事诉讼法》和《人民检察院刑事诉讼规则》等规定，结合监外执行检察工作实际，提出如下意见：
　　一、充分认识加强对监外执行罪犯脱管、漏管问题检察监督的重要意义
长期以来，一些地方对监外执行工作重视不够，对监外执行罪犯没有依法交付执行和进行有效的监督管理，加之市场经济条件下人员流动性加大，监外执行罪犯脱管、漏管成为当前刑罚执行中的一个突出问题。有的监外执行罪犯脱管、漏管后继续违法犯罪，影响了社会的稳定。各级人民检察院要从保障刑事判决、裁定的依法有效执行，维护社会的和谐稳定出发，把加强对监外执行罪犯特别是暂予监外执行、假释、缓刑罪犯脱管、漏管问题的检察监督，作为监外执行检察工作的重点，加大检察监督力度，促进交付执行机关和基层执行机关依法履行职责。
