The Contracting Parties,

Recognising the desirability of regulating in a uniform manner the conditions of international carriage by air, so far as may concern the documents of carriage and the responsibility of the carrier,

Have, for this purpose, appointed their respective Plenipotentiaries who, being duly authorised, have concluded and signed the following Convention:
 
缔约国认为,国际航空运输的条件,在所用文件和承运人的责任方面,有统一规定的必要,为此目的,各派全权代表,经正式授权,签订本公约如下:

 
Chapter I: Scope - Definitions 

第一章 范围和定义


 
Article 1   第一条

 
1. This Convention applies to all international carriage of persons, luggage or goods performed by aircraft for reward. It applies equally to gratuitous carriage by aircraft performed by an air transport undertaking. (1)本公约适用于所有以航空器运送旅客、行李或货物而收取报酬的国际运输。本公约同样适用于航空运输企业以航空器办理的免费运输。

 
2. For the purposes of this Convention the expression "international carriage" means any carriage in which, according to the contract made by the parties, the place of departure and the place of destination, whether or not there be a break in the carriage or a transshipment, are situated either within the territories of two High Contracting Parties, or within the territory of a single High Contracting Party, if there is an agreed stopping place within a territory subject to the sovereignty, suzerainty, mandate or authority of another Power, even though that Power is not a party to this Convention. A carriage without such an agreed stopping place between territories subject to the sovereignty, suzerainty, mandate or authority of the same High Contracting Party is not deemed to be international for the purposes of this Convention. (2)本公约所指的“国际运输”的意义是:根据有关各方所订的合同,不论在运输中是否有间断或转运,其出发地和目的地是在两个缔约国或非缔约国的主权、宗主权、委任统治权或权力管辖下的领土内有一个约定的经停地点的任何运输。在同一缔约国的主权、宗主权、委任统治权或权力管辖下的领土间的运输,如果没有这种约定的经停地点,对本公约来说不作为国际运输。

 
3. A carriage to be performed by several successive air carriers is deemed, for the purposes of this Convention, to be one undivided carriage, if it has been regarded by the parties as a single operation, whether it had been agreed upon under the form of a single contract or of a series of contracts, and it does not lose its international character merely because one contract or a series of contracts is to be performed entirely within a territory subject to the sovereignty, suzerainty, mandate or authority of the same High Contracting Party. (3)几个连续的航空承运人所办理的运输,如果被合同各方认为是一个单一的业务活动,则无论是以一个合同或一系列的合同的形式订立的,就本公约的适用来说,应作为一个单一的运输,并不因其中一个合同或一系列的合同完全在同一缔约国的主权、宗主权、委任统治权或权力管辖下的领土内履行而丧失其国际性质。

 
Article 2   第二条

 
1. This Convention applies to carriage performed by the State or by legally constituted public bodies provided it falls within the conditions laid down in Article 1. (1)本公约适用于国家或其他公法人在第一条规定的条件下所办理的运输。

 
2. This Convention does not apply to carriage performed under the terms of any international postal Convention. (2)本公约不适用于按照国际邮政公约的规定而办理的运输。

 
Chapter II: Documents of Carriage 

第二章 运输凭证


 
Section I: Passenger Ticket 

第一节 客票


 
Article 3   第三条

 
1. For the carriage of passengers the carrier must deliver a passenger ticket which shall contain the following particulars: (1)承运人运送旅客时必须出具客票,客票上应该包括以下各项:

 
(a) the place and date of issue; (一)出票地点和日期;

 
(b) the place of departure and of destination; (二)出发地和目的地;

 
(c) the agreed stopping places, provided that the carrier may reserve the right to alter the stopping places in case of necessity, and that if he exercises that right, the alteration shall not have the effect of depriving the carriage of its international character; (三)约定的经停地点,但承运人保留在必要时变更经停地点的权利,承运人行使这种权利时,不应使运输由于这种变更而丧失其国际性质;

 
(d) the name and address of the carrier or carriers; (四)承运人的名称和地址;

 
(e) a statement that the carriage is subject to the rules relating to liability established by this Convention. (五)声明运输应受本公约所规定责任制的约束。

 
2. The absence, irregularity or loss of the passenger ticket does not affect the existence or the validity of the contract of carriage, which shall none the less be subject to the rules of this Convention. Nevertheless, if the carrier accepts a passenger without a passenger ticket having been delivered he shall not be entitled to avail himself of those provisions of this Convention which exclude or limit his liability. (2)如果没有客票、或客票不合规定或客票遗失,不影响运输合同的存在和有效,这项运输合同仍将受本公约规则的约束。但是如果承运人承运旅客而不出具客票,承运人就无权引用本公约关于免除或限制承运人责任的规定。

 
Section II: Luggage Ticket 

第二节 行李票


 
Article 4   第四条

 
1. For the carriage of luggage, other than small personal objects of which the passenger takes charge himself, the carrier must deliver a luggage ticket. (1)运送行李时,除由旅客自行保管的小件个人用品外,承运人必须出具行李票。

 
2. The luggage ticket shall be made out in duplicate, one part for the passenger and the other part for the carrier. (2)行李票应备一式两份,一份交旅客,一份归承运人。

 
3. The luggage ticket shall contain the following particulars: (3)行李票上应包括以下各项:

 
(a) the place and date of issue; (一)出票地点和日期;

 
(b) the place of departure and of destination; (二)起运地和目的地;

 
(c) the name and address of the carrier or carriers; (三)承运人的名称和地址;

 
(d) the number of the passenger ticket; (四)客票的号码;

 
(e) a statement that delivery of the luggage will be made to the bearer of the luggage ticket; (五)声明行李将交给行李票持有人;

 
(f) the number and weight of the packages; (六)行李件数和重量

 
(g) the amount of the value declared in accordance with Article 22(2); (七)根据第二十二条(2)款声明的价值;

 
(h) a statement that the carriage is subject to the rules relating to liability established by this Convention. (八)声明运输应受本公约所规定责任制度的约束。

 
4. The absence, irregularity or loss of the luggage ticket does not affect the existence or the validity of the contract of carriage, which shall none the less be subject to the rules of this Convention. Nevertheless, if the carrier accepts luggage without a luggage ticket having been delivered, or if the luggage ticket does not contain the particulars set out at (d), (f) and (h) above, the carrier shall not be entitled to avail himself of those provisions of the Convention which exclude or limit his liability. (4)如果没有行李票、或行李票不合规定或行李票遗失,不影响运输合同的存在和有效,这项运输合同仍将同样受本公约的规则的约束。但是如果承运人接受行李而不出具行李票,或行李票上没有包括以上(四)(六)(八)各项,承运人就无权引用本公约关于免除或限制承运人责任的规定。第三节 航空货运单

 
Article 5   第五条

 
1. Every carrier of goods has the right to require the consignor to make out and hand over to him a document called an "air consignment note"; every consignor has the right to require the carrier to accept this document. (1)货物承运人有权要求托运人填写一称为“航空货运单”的凭证,托运人有权要求承运人接受这项凭证。

 
2. The absence, irregularity or loss of this document does not affect the existence or the validity of the contract of carriage which shall, subject to the provisions of Article 9, be none the less governed by the rules of this Convention. (2)但是如果没有这种凭证,或凭证不合规定或凭证遗失,不影响运输合同的存在和有效,除第九条另有规定外,这项运输合同同样受本公约的规则的约束。

 
Article 6   第六条

 
1. The air consignment note shall be made out by the consignor in three original parts and be handed over with the goods. (1)托运人应填写航空货运单正张一式三份,连同货物交给承运人。

 
2. The first part shall be marked "for the carrier," and shall be signed by the consignor. The second part shall be marked "for the consignee"; it shall be signed by the consignor and by the carrier and shall accompany the goods. The third part shall be signed by the carrier and handed by him to the consignor after the goods have been accepted. (2)第一份注明“交承运人”,由托运人签字;第二份注明“交收货人”,由托运人和承运人签字,并附在货物上;第三份由承运人在接受货物后签字,交给托运人。

 
3. The carrier shall sign on acceptance of the goods. (3)承运人应该在接受货物时签字。

 
4. The signature of the carrier may be stamped; that of the consignor may be printed or stamped. (4)承运人的签字可以用戳记代替,托运人的签字可以印就或用戳记代替。

 
5. If, at the request of the consignor, the carrier makes out the air consignment note, he shall be deemed, subject to proof to the contrary, to have done so on behalf of the consignor. (5)如果承运人根据托运人的请求,填写航空货运单,在没有相反的证据时,应作为代托运人填写。

 
Article 7   第七条

The carrier of goods has the right to require the consignor to make out separate consignment notes when there is more than one package.
 
如果货物不止一件时,承运人有权要求托运人分别填写航空货运单。

 
Article 8   第八条

The air consignment note shall contain the following particulars:
 
航空货运单上应该包括以下各项:

 
(a) the place and date of its execution; (一)货运单的填写地点和日期;

 
(b) the place of departure and of destination; (二)起运地和目的地;

 
(c) the agreed stopping places, provided that the carrier may reserve the right to alter the stopping places in case of necessity, and that if he exercises that right the alteration shall not have the effect of depriving the carriage of its international character; (三)约定的经停地点,但承运人保留在必要时变更经停地点的权利,承运人行使这种权利时,不应使运输由于这种变更而丧失其国际性质;

 
(d) the name and address of the consignor; (四)托运人的名称和地址;

 
(e) the name and address of the first carrier; (五)第一承运人的名称和地址;

 
(f) the name and address of the consignee, if the case so requires; (六)必要时应写明收货人的名称和地址;

 
(g) the nature of the goods; (七)货物的性质;

 
(h) the number of the packages, the method of packing and the particular marks or numbers upon them; (八)包装件数、包装方式、特殊标志或号数;

 
(i) the weight, the quantity and the volume or dimensions of the goods; (九)货物的重量、数量、体积或尺寸;

 
(j) the apparent condition of the goods and of the packing; (十)货物和包装的外表情况;

 
(k) the freight, if it has been agreed upon, the date and place of payment, and the person who is to pay it; (十一)如果运费已经议定,应写明运费金额、付费日期和地点以及付费人;

 
(l) if the goods are sent for payment on delivery, the price of the goods, and, if the case so requires, the amount of the expenses incurred; (十二)如果是货到付款,应写明货物的价格,必要时还应写明应付的费用;

 
(m) the amount of the value declared in accordance with Article 22 (2); (十三)根据第二十二条(2)款声明的价值;

 
(n) the number of parts of the air consignment note; (十四)航空货运单的份数;

 
(o) the documents handed to the carrier to accompany the air consignment note; (十五)随同航空货运单交给承运人的凭证;

 
(p) the time fixed for the completion of the carriage and a brief note of the route to be followed, if these matters have been agreed upon; (十六)如果经过约定,应写明运输期限,并概要说明经过的路线;

 
(q) a statement that the carriage is subject to the rules relating to liability established by this Convention. (十七)声明运输应受本公约所规定责任制度的约束。

 
Article 9   第九条

If the carrier accepts goods without an air consignment note having been made out, or if the air consignment note does not contain all the particulars set out in Article 8(a) to (i) inclusive and (q), the carrier shall not be entitled to avail himself of the provisions of this Convention which exclude or limit his liability.
 
如果承运人接受货物而没有填写航空货运单,或航空货运单没有包括第八条(一)至(九)和(十七)各项,承运人就无权引用本公约关于免除或限制承运人责任的规定。

 
Article 10   第十条

 
1. The consignor is responsible for the correctness of the particulars and statements relating to the goods which he inserts in the air consignment note. (1)对于在航空货运单上所填关于货物的各项说明和声明的正确性,托运人应负责任。

 
2. The consignor will be liable for all damage suffered by the carrier or any other person by reason of the irregularity, incorrectness or incompleteness of the said particulars and statements. (2)对于因为这些说明和声明不合规定、不正确、或不完备而使承运人或任何其他人遭受的一切损失,托运人应负责任。

 
Article 11   第十一条

 
1. The air consignment note is prima facie evidence of the conclusion of the contract, of the receipt of the goods and of the conditions of carriage. (1)在没有相反的证据时,航空货运单是订立合同、接受货物和承运条件的证明。

 
2. The statements in the air consignment note relating to the weight, dimensions and packing of the goods, as well as those relating to the number of packages, are prima facie evidence of the facts stated; those relating to the quantity, volume and condition of the goods do not constitute evidence against the carrier except so far as they both have been, and are stated in the air consignment note to have been, checked by him in the presence of the consignor, or relate to the apparent condition of the goods. (2)在没有相反的证据时,航空货运单中关于货物重量、尺寸和包装以及件数的说明,都应该被当作是确实的。除非经过承运人和托运人当面查对并在航空货运单中注明经过查对,或者是关于货物外表情况的说明外,关于货物的数量、体积及情况的说明不能构成不利承运人的证据。
