| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 These Measures are developed in accordance with the Intangible Cultural Heritage Law of the People's Republic of China and other relevant laws and regulations to strengthen the overall regional protection of intangible cultural heritage, maintain and nurture cultural ecology, carry forward the fine traditional Chinese culture, build stronger cultural confidence, and meet people's ever-growing needs for a better life. | | 第一条 为加强非物质文化遗产区域性整体保护，维护和培育文化生态，传承弘扬中华优秀传统文化，坚定文化自信，满足人民日益增长的美好生活需要，根据《中华人民共和国非物质文化遗产法》等法律法规，制定本办法。 |
| Article 2 For the purpose of these Measures, “National Eco-cultural Protection Zone” means the specific area established with the approval of the Ministry of Culture and Tourism, which takes the protection of intangible cultural heritage as the core and provides integrated protection of the cultural form in good condition that has great historical and cultural accumulation, important value and distinctive characteristics. | | 第二条 本办法所称的“国家级文化生态保护区”，是指以保护非物质文化遗产为核心，对历史文化积淀丰厚、存续状态良好，具有重要价值和鲜明特色的文化形态进行整体性保护，并经文化和旅游部同意设立的特定区域。 |
| Article 3 The construction of national eco-cultural protection zones shall be guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, fully respect the people's principal position, implement the new development concept, and promote core socialist values so as to advance the creative transformation and innovative development of the fine traditional Chinese culture. | | 第三条 国家级文化生态保护区建设要以习近平新时代中国特色社会主义思想为指导，充分尊重人民群众的主体地位，贯彻新发展理念，弘扬社会主义核心价值观，推动中华优秀传统文化创造性转化、创新性发展。 |
| Article 4 The construction of national eco-cultural protection zones shall give priority to protection and focus on integrated protection. That is to say, it shall protect not only the intangible cultural heritage but the cultural and natural environment that nurtures and develops the intangible cultural heritage, in an effort to achieve the goal of “rich heritage, strong atmosphere, distinctive characteristics and people's benefits.” | | 第四条 国家级文化生态保护区建设应坚持保护优先、整体保护、见人见物见生活的理念，既保护非物质文化遗产，也保护孕育发展非物质文化遗产的人文环境和自然环境，实现“遗产丰富、氛围浓厚、特色鲜明、民众受益”的目标。 |
| Chapter Ⅱ Application and Establishment | | 第二章 申报与设立 |
| Article 5 A national eco-cultural protection zone shall be established by relying on relevant administrative regions, and the area scope may be a county, prefecture or several counties. | | 第五条 国家级文化生态保护区依托相关行政区域设立，区域范围为县、地市或若干县域。 |
| Article 6 The application and establishment of national eco-cultural protection zones shall be few but good, adhere to the principles of openness, fairness and impartiality, and implement the procedures of application, examination, demonstration and approval. | | 第六条 申报和设立国家级文化生态保护区应本着少而精的原则，坚持公开、公平、公正，履行申报、审核、论证、批准等程序。 |
| Article 7 A region meeting the following conditions may apply for being a national eco-cultural protection zone: | | 第七条 具备下列条件的，可以申报国家级文化生态保护区： |
| (1) It has great historical and cultural accumulation, distinctive regional or ethnic characteristics, and good cultural ecology. | | （一）传统文化历史积淀丰厚，具有鲜明地域或民族特色，文化生态保持良好； |
| (2) It has abundant intangible cultural heritage resources, which are an important part of local production and life. | | （二）非物质文化遗产资源丰富，是当地生产生活的重要组成部分； |
| (3) The intangible cultural heritage is carried forward in an orderly manner, which is full of vitality and strong atmosphere. The local people are widely involved and have a strong sense of identity. | | （三）非物质文化遗产传承有序，传承实践富有活力、氛围浓厚，当地民众广泛参与，认同感强； |
| (4) The material objects and sites closely related to the intangible cultural heritage are well preserved and utilized, and the surrounding natural ecology and environment can provide benign development space for the intangible cultural heritage. | | （四）与非物质文化遗产密切相关的实物、场所保存利用良好，其周边的自然生态环境能为非物质文化遗产提供良性的发展空间； |
| (5) The local people's government attaches importance to the protection of cultural ecology, draw up a list of the towns, villages, communities and other key areas that have more intangible cultural heritage projects, basically sound natural ecology and environment and relatively well-preserved traditional cultural ecology as well as important sites where inheritance of intangible cultural heritage is carried out, and has developed and implemented protective measures. | | （五）所在地人民政府重视文化生态保护，对非物质文化遗产项目集中、自然生态环境基本良好、传统文化生态保持较为完整的乡镇、村落、街区等重点区域以及开展非物质文化遗产传承所依存的重要场所开列清单，并已经制定实施保护办法和措施； |
| (6) It has the administrative organs and personnel for the construction of eco-cultural protection zones. | | （六）有文化生态保护区建设管理机构和工作人员； |
| (7) It has carried out overall regional protection of cultural ecology within the province (autonomous region or municipality direct under the Central Government) for more than two years, with remarkable results. | | （七）在省（区、市）内已实行文化生态区域性整体保护两年以上，成效明显。 |
| Article 8 The people's government of the region making application shall apply to the department in charge of cultural affairs under the people's government at the provincial level for a national eco-cultural protection zone. The latter shall organize examination and demonstration, and after approval by the people's government at the provincial level, apply to the Ministry of Culture and Tourism for the establishment of a national eco-cultural protection zone. | | 第八条 申报地区人民政府向省级人民政府文化主管部门提出申报国家级文化生态保护区的申请；省级人民政府文化主管部门组织开展审核论证，经省级人民政府同意后，向文化和旅游部提出设立国家级文化生态保护区的申请。 |
| Article 9 In applying for a national eco-cultural protection zone, a region shall submit the following materials: | | 第九条 申报国家级文化生态保护区，应当提交下列材料： |
| (1) The application for the establishment of a national eco-cultural protection zone by the department in charge of cultural affairs under the people's government at the provincial level and documents related to approval of application by the people's government at the provincial level. | | （一）省级人民政府文化主管部门设立国家级文化生态保护区的申请和省级人民政府同意申请的相关文件； |
| (2) The planning outline for eco-cultural protection zones. | | （二）文化生态保护区规划纲要； |
| (3) The opinions on expert review and demonstration organized by the department in charge of cultural affairs under the people's government at the provincial level. | | （三）省级人民政府文化主管部门组织的专家评审论证意见； |
| (4) Related documents on overall regional protection of cultural ecology conducted within the province (autonomous region or municipality directly under the Central Government). | | （四）本省（区、市）内实行文化生态区域性整体保护的相关文件； |
| (5) Other relevant materials. | | （五）其他有关材料。 |
| Article 10 The planning outline for eco-cultural protection zones shall be prepared by the department in charge of cultural affairs under the people's government at the provincial level and the people's government of the relevant region. When compiling the outline, the relevant department shall listen widely to inheritors of intangible cultural heritage and local people, and get experts and scholars in intangible cultural heritage protection and local cultural research and planning to participate in the compilation work. | | 第十条 文化生态保护区规划纲要由省级人民政府文化主管部门、相关地区人民政府负责编制。编制工作应广泛听取非物质文化遗产传承人和当地民众意见，吸收非物质文化遗产保护、地方文化研究、规划等方面的专家学者参与。 |
| Article 11 The planning outline for eco-cultural protection zones shall include the following: | | 第十一条 文化生态保护区规划纲要应包括下列内容： |
| (1) The description and analysis of the geographical environment, historical evolution, current situation, distinctive characteristics, and cultural connotation and value of the cultural form. | | （一）对文化形态形成的地理环境、历史沿革、现状、鲜明特色、文化内涵与价值的描述和分析； |
(2) The scope of protected areas and the key areas, the list of representative projects of intangible cultural heritage at or above the county level, cultural relics under protection, relevant physical objects and important sites within the areas, among others.
