| Article 1 For the purposes of improving the mechanism of external supervision and restriction over the exercise of procuratorial power, protecting the fulfillment of duties by people's supervisors according to the law, promoting judicial justice, and enhancing judicial credibility, these Provisions are developed in accordance with the provisions as prescribed in the Organic Law of the People's Procuratorates of the People's Republic of China. | | 第一条 为了健全检察权运行的外部监督制约机制，保障人民监督员依法履行职责，促进司法公正，提升司法公信，根据《中华人民共和国人民检察院组织法》等规定，制定本规定。 |
| Article 2 The case handling activities of the people's procuratorates shall be subject to the supervision of people's supervisors in accordance with the laws and these Provisions. | | 第二条 人民检察院的办案活动依照法律和本规定接受人民监督员的监督。 |
| Article 3 People's supervisors shall fulfill their duties of supervision independently and impartially according to the law. | | 第三条 人民监督员依法、独立、公正履行监督职责。 |
| The supervision right of people's supervisors shall be protected by law. | | 人民监督员行使监督权受法律保护。 |
| When fulfilling their duties of supervision, people's supervisors shall observe the state laws, regulations and confidentiality provisions. | | 人民监督员履行监督职责，应当遵守国家法律、法规和保密规定。 |
| Article 4 A people's procuratorate shall protect the fulfillment of duties by people's supervisors and voluntarily accept the supervision of people's supervisors. | | 第四条 人民检察院应当保障人民监督员履行监督职责，自觉接受人民监督员的监督。 |
| Article 5 The selection, training, assessment and other management work of people's supervisors shall be conducted by the judicial administrative authorities according to the relevant provisions with the coordinated assistance of the people's procuratorates. | | 第五条 人民监督员的选任和培训、考核等管理工作，依照相关规定由司法行政机关负责，人民检察院予以配合协助。 |
| Article 6 The people's procuratorates at all levels shall specify an organization responsible for the work of people's supervisors. The main responsibilities of the organization include: | | 第六条 各级人民检察院应当明确负责人民监督员工作的机构。人民监督员工作机构的主要职责是： |
| 1. organizing the supervision and case handling activities of people's supervisors; | | （一）组织人民监督员监督办案活动； |
| 2. reporting the procuratorial work; | | （二）通报检察工作情况； |
| 3. accepting, reviewing, and handling the supervision requirements and relevant materials proposed by people's supervisors; | | （三）受理、审查、办理人民监督员提出的监督要求和相关材料； |
| 4. coordinating with and overseeing relevant departments in handling supervision matters; | | （四）协调、督促相关部门办理监督事项； |
| 5. providing feedback on and supervising the case handling results; and | | （五）反馈监督案件处理结果； |
| 6. other works related to the fulfillment of duties of people's supervisors. | | （六）有关人民监督员履职的其他工作。 |
| Article 7 When supervising the procuratorial and case handling activities, people's supervisors shall observe the provisions for disqualification of people's supervisors. | | 第七条 人民监督员对检察办案活动实行监督，应当遵守有关人民监督员回避的规定。 |
| Article 8 The people's procuratorates shall arrange for people's supervisors to supervise the following work according to the law: | | 第八条 人民检察院下列工作可以安排人民监督员依法进行监督： |
| 1. public review and public hearing of a case; | | （一）案件公开审查、公开听证； |
| 2. a prosecutor's appearance in court for public prosecution; | | （二）检察官出庭支持公诉； |
| 3. tour procuratorial inspection; | | （三）巡回检察； |
| 4. research, formulation, supervision and implementation of a procuratorial proposal; | | （四）检察建议的研究提出、督促落实等相关工作； |
| 5. declaration of service of legal documents; | | （五）法律文书宣告送达； |
| 6. case quality examination; | | （六）案件质量评查； |
| 7. examination of judicial standardization; | | （七）司法规范化检查； |
| 8. reporting of the procuratorial work; and | | （八）检察工作情况通报； |
| 9. other works related to judicial case handling. | | （九）其他相关司法办案工作。 |
Article 9 If a people's procuratorate conducts public review of criminal appeal cases concerning the handling decisions of procuratorial organs, cases that procuratorial organs decide not to prosecute, or cases about examination of custody necessities, or holds public hearings on cases concerning approving an arrest which have a significant impact or administrative prosecution supervision cases, the people's procuratorate shall invite people's supervisors to participate, and listen to their opinions on the determination of case facts and evidences as well as case handling.
．．．．．． | | 第九条 人民检察院对不服检察机关处理决定的刑事申诉案件、拟决定不起诉的案件、羁押必要性审查案件等进行公开审查，或者对有重大影响的审查逮捕案件、行政诉讼监督案件等进行公开听证的，应当邀请人民监督员参加，听取人民监督员对案件事实、证据的认定和案件处理的意见。
