The Party committees and the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government; Central Committee of the CPC, and all ministries and commissions under the State Council; all entities of the People's Liberation Army; all departments of the Central Military Commission; and all people's organizations: 各省、自治区、直辖市党委和人民政府,中央和国家机关各部委,解放军各大单位,中央军委机关各部门,各人民团体:
The Provisions on the Functions, Structure and Staffing of the Ministry of Natural Resources, as reviewed by the State Commission Office of Public Sectors Reform, with the approval of the CPC Central Committee and the State Council, are hereby issued. 《自然资源部职能配置、内设机构和人员编制规定》经中央机构编制委员会办公室审核后,已报党中央、国务院批准,现予印发。

Provisions on the Functions, Structure and Staffing of the Ministry of Natural Resources 自然资源部职能配置、内设机构和人员编制规定
Article 1 These Provisions are developed according to the Decision of the CPC Central Committee on Deepening the Reform of the Party and State Institutions and the Proposal for Deepening the Reform of the Party and State Institutions, as deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee, and the State Council Institutional Reform Proposal as approved at the First Session of the Thirteenth National People's Congress.   第一条 根据党的十九届三中全会审议通过的《中共中央关于深化党和国家机构改革的决定》、《深化党和国家机构改革方案》和第十三届全国人民代表大会第一次会议批准的《国务院机构改革方案》,制定本规定。
Article 2 The Ministry of Natural Resources shall be an integral department of the State Council at the ministerial level, retaining the plaque of the State Oceanic Administration externally.   第二条 自然资源部是国务院组成部门,为正部级,对外保留国家海洋局牌子。
Article 3 The Ministry of Natural Resources shall implement the guidelines, decisions and arrangements of the CPC Central Committee relating to natural resources and adhere to and strengthen centralized and unified party leadership over natural resource work in the course of performing its duties, mainly:   第三条 自然资源部贯彻落实党中央关于自然资源工作的方针政策和决策部署,在履行职责过程中坚持和加强党对自然资源工作的集中统一领导。主要职责是:
(1) Performing the duties of the owner of natural resources owned by the whole people, such as land, minerals, forests, grasslands, wetlands, water, and oceans, and the duties to control the use of all spaces. Preparing bills of laws and regulations on natural resources, spatial planning and surveying, polar, and deep sea, among others, and formulating as well as supervising and inspecting the implementation of departmental rules. (一)履行全民所有土地、矿产、森林、草原、湿地、水、海洋等自然资源资产所有者职责和所有国土空间用途管制职责。拟订自然资源和国土空间规划及测绘、极地、深海等法律法规草案,制定部门规章并监督检查执行情况。
(2) Responsible for surveying, monitoring and evaluating natural resources. Formulating an indicator system and statistical standards for surveying, monitoring and evaluating natural resources and establishing a unified and well-regulated survey, monitoring and evaluation system for natural resources. Implementing basic surveys, special surveys and monitoring of natural resources. Responsible for supervising and administering the results of surveys, monitoring and evaluation of natural resources and releasing information. Guiding local governments' surveys, monitoring and evaluation of natural resources. (二)负责自然资源调查监测评价。制定自然资源调查监测评价的指标体系和统计标准,建立统一规范的自然资源调查监测评价制度。实施自然资源基础调查、专项调查和监测。负责自然资源调查监测评价成果的监督管理和信息发布。指导地方自然资源调查监测评价工作。
(3) Responsible for the unified recognition and registration of natural resources. Formulating systems, standards, and rules for the unified right recognition and registration of various natural resources and immovables, title investigation, immovable mapping, dispute mediation, and the application of results. Establishing and improving a national basic management platform for registration information of natural resources and immovables. Responsible for the collection, sorting, sharing, and consolidated submission administration of registration materials on natural resources and immovables. Guiding and supervising the right recognition and registration of natural resources and immovables across the country. (三)负责自然资源统一确权登记工作。制定各类自然资源和不动产统一确权登记、权籍调查、不动产测绘、争议调处、成果应用的制度、标准、规范。建立健全全国自然资源和不动产登记信息管理基础平台。负责自然资源和不动产登记资料收集、整理、共享、汇交管理等。指导监督全国自然资源和不动产确权登记工作。
(4) Responsible for the work on the onerous use of natural resource assets. Establishing a statistical system for natural resource assets owned by the whole people and responsible for keeping accounts of natural resource assets owned by the whole people. Preparing a balance sheet for natural resources owned by the whole people and drawing up evaluation criteria. Formulating policies for the allocation, transfer, leasing, and appraised-value contribution of natural resource assets owned by the whole people and land stockpiling and reasonably allocating natural resource assets owned by the whole people. Responsible for managing the appraisement of natural resource assets and collecting relevant asset income according to the law. (四)负责自然资源资产有偿使用工作。建立全民所有自然资源资产统计制度,负责全民所有自然资源资产核算。编制全民所有自然资源资产负债表,拟订考核标准。制定全民所有自然资源资产划拨、出让、租赁、作价出资和土地储备政策,合理配置全民所有自然资源资产。负责自然资源资产价值评估管理,依法收缴相关资产收益。
(5) Responsible for the reasonable development and utilization of natural resources. Organizing the preparation of natural resource development plans and strategies, formulating and organizing the implementation of standards for the development and utilization of natural resources, establishing a system for the government to publish natural resource prices, organizing the grading and price assessment of natural resources, evaluating the utilization of natural resources, and guiding conservation and intensive utilization. Responsible for the regulation of natural resource markets. Organizing the research on policies and measures for macro-regulation, regional coordination, and urban-rural integration relating to natural resource management. (五)负责自然资源的合理开发利用。组织拟订自然资源发展规划和战略,制定自然资源开发利用标准并组织实施,建立政府公示自然资源价格体系,组织开展自然资源分等定级价格评估,开展自然资源利用评价考核,指导节约集约利用。负责自然资源市场监管。组织研究自然资源管理涉及宏观调控、区域协调和城乡统筹的政策措施。
(6) Responsible for establishing a spatial planning system and supervising its implementation. Advancing the main functional area strategy and system and organizing the preparation and supervising the implementation of national spatial plans and related special plans. Assessing the suitability of spatial development and establishing a monitoring, assessment and early warning system for the implementation of spatial plans. Organizing the delineation of control lines such as ecological protection red line, permanent basic farmland, and urban development boundary and developing a production, living, and ecological spatial layout that conserves resources and protects the environment. Establishing and improving a space use control system and studying the preparation and supervising the implementation of urban and rural planning policies. Organizing the preparation of and implementing annual utilization plans for natural resources such as land and sea. Responsible for changing the use of land, sea areas, islands and other spaces. Responsible for administering expropriation and requisition of land. (六)负责建立空间规划体系并监督实施。推进主体功能区战略和制度,组织编制并监督实施国土空间规划和相关专项规划。开展国土空间开发适宜性评价,建立国土空间规划实施监测、评估和预警体系。组织划定生态保护红线、永久基本农田、城镇开发边界等控制线,构建节约资源和保护环境的生产、生活、生态空间布局。建立健全国土空间用途管制制度,研究拟订城乡规划政策并监督实施。组织拟订并实施土地、海洋等自然资源年度利用计划。负责土地、海域、海岛等国土空间用途转用工作。负责土地征收征用管理。
(7) Responsible for coordinating the ecological remediation of spaces. Taking the lead in organizing the preparation of ecological remediation plans for spaces and implementing relevant major ecological remediation projects. Responsible for comprehensive remediation of spaces, land consolidation and reclamation, remediation of mines' geological environment, marine ecology, sea areas and coastline, island remediation, and other projects. Taking the lead in establishing and implementing an ecological protection compensation system, formulating policies and measures to reasonably use social funds for ecological remediation, and proposing major alternative projects. (七)负责统筹国土空间生态修复。牵头组织编制国土空间生态修复规划并实施有关生态修复重大工程。负责国土空间综合整治、土地整理复垦、矿山地质环境恢复治理、海洋生态、海域海岸线和海岛修复等工作。牵头建立和实施生态保护补偿制度,制定合理利用社会资金进行生态修复的政策措施,提出重大备选项目。
(8) Responsible for organizing the implementation of the most stringent cultivated land protection system. Taking the lead in preparing and implementing cultivated land protection policies and responsible for the quantity, quality and ecological protection of cultivated land. Organizing the implementation of responsibility and objective evaluation for cultivated land protection and special protection of permanent basic farmland. Improving the balance system for cultivated land occupation and compensation and supervising the implementation of the compensation system for occupied cultivated land. (八)负责组织实施最严格的耕地保护制度。牵头拟订并实施耕地保护政策,负责耕地数量、质量、生态保护。组织实施耕地保护责任目标考核和永久基本农田特殊保护。完善耕地占补平衡制度,监督占用耕地补偿制度执行情况。
(9) Responsible for administering the geological exploration industry and nationwide geological work. Preparing geological exploration plans and supervising and inspecting the implementation. Managing central-level geological exploration projects. Organizing the implementation of national major special projects of geological and mineral exploration. Responsible for preventing and managing geological disasters and supervising and administering geological problems, such as ground subsidence caused by over-exploitation of groundwater. Responsible for supervising and administering fossils. (九)负责管理地质勘查行业和全国地质工作。编制地质勘查规划并监督检查执行情况。管理中央级地质勘查项目。组织实施国家重大地质矿产勘查专项。负责地质灾害预防和治理,监督管理地下水过量开采及引发的地面沉降等地质问题。负责古生物化石的监督管理。
(10) Responsible for implementing the relevant requirements for comprehensive disaster prevention and mitigation plans and organizing the preparation and guiding the implementation of geological disaster prevention plans and protection standards. Organizing the guidance and coordination of and supervising surveys and evaluation of geological disasters as well as census, detailed surveys and screening of hidden risks. Guiding group predication and prevention, professional monitoring, forecasting and early warning, and other work and guiding engineering management of geological disasters. Undertaking technical support for emergency response and rescue in geological disasters. (十)负责落实综合防灾减灾规划相关要求,组织编制地质灾害防治规划和防护标准并指导实施。组织指导协调和监督地质灾害调查评价及隐患的普查、详查、排查。指导开展群测群防、专业监测和预报预警等工作,指导开展地质灾害工程治理工作。承担地质灾害应急救援的技术支撑工作。
(11) Responsible for managing mineral resources. Responsible for administering mineral resource reserves and approving overlain mineral resources. Responsible for administering mineral rights. In conjunction with relevant authorities, undertaking the regulation of specific minerals and advantageous minerals for protective mining and relevant administration. Supervising and guiding the reasonable use and protection of mineral resources. (十一)负责矿产资源管理工作。负责矿产资源储量管理及压覆矿产资源审批。负责矿业权管理。会同有关部门承担保护性开采的特定矿种、优势矿产的调控及相关管理工作。监督指导矿产资源合理利用和保护。
(12) Responsible for supervising the implementation of marine strategic plans and developing the marine economy. Studying and putting forward proposals for major strategies for the construction of a maritime power. Organizing the formulation and supervising the implementation of marine development, deep sea and polar strategies. In conjunction with relevant authorities, preparing and supervising the implementation of plans and policies for marine economic development and comprehensive protection and utilization of coastal zones. Responsible for monitoring and assessing marine economic operations. (十二)负责监督实施海洋战略规划和发展海洋经济。研究提出海洋强国建设重大战略建议。组织制定海洋发展、深海、极地等战略并监督实施。会同有关部门拟订海洋经济发展、海岸带综合保护利用等规划和政策并监督实施。负责海洋经济运行监测评估工作。
(13) Responsible for supervising and administering marine development, utilization and protection. Responsible for administering the use of sea areas and the protection and utilization islands. Formulating and supervising the implementation of sea areas and islands protection and utilization plans. Responsible for administering the names of uninhabited islands, sea areas and seabed terrain and formulating and supervising the implementation of measures for the administration of special-use islands such as territorial sea bases. Responsible for marine observation and forecasting, early warning and monitoring, and disaster reduction and participating in emergency response to major marine disasters. (十三)负责海洋开发利用和保护的监督管理工作。负责海域使用和海岛保护利用管理。制定海域海岛保护利用规划并监督实施。负责无居民海岛、海域、海底地形地名管理工作,制定领海基点等特殊用途海岛保护管理办法并监督实施。负责海洋观测预报、预警监测和减灾工作,参与重大海洋灾害应急处置。
(14) Responsible for administering surveying and mapping geographic information. Responsible for basic mapping and the administration of the surveying industry. Responsible for administering surveying and mapping qualifications and credit and supervising and administering national geographic information security and market order. Responsible for administering public services in geographic information. Responsible for measuring mark protection. (十四)负责测绘地理信息管理工作。负责基础测绘和测绘行业管理。负责测绘资质资格与信用管理,监督管理国家地理信息安全和市场秩序。负责地理信息公共服务管理。负责测量标志保护。
