| Article 1. For the purpose of regulating the management of state science and technology plans, clearly setting up basic procedures and requirements for state science and technology plans, strengthening the responsibility mechanism of the management of state science and technology plans and establishing the basic system of the management of state science and technology plans, these Rules are formulated according to relevant requirements of the Scientific and Technological ProgressLaw of the People's Republic of China. | | 第一条 为了规范国家科技计划管理，明确设立国家科技计划的基本程序和要求，强化国家科技计划管理的责任机制，建立国家科技计划管理的基本制度，根据《中华人民共和国科学技术进步法》的有关要求，制定本规定。 |

| Article 2. “State science and technology plans” used in these Rules refers to: scientific research and experiment development activities and other relevant scientific and technological activities which are organized and carried out by government administrative departments in accordance with state development planning and strategic arrangements of science and technology, and are supported by the central finance or regulated, directed by macro policies. State science and technology plans are important means by which the state settles major scientific and technological problems involved in social and economic development, and realizes reasonable disposition of scientific and technological resources. | | 第二条 本规定所称的国家科技计划是指：根据国家科技发展规划和战略安排的，以中央财政支持或以宏观政策调控、引导，由政府行政部门组织和实施的科学研究与试验发展活动及相关的其它科学技术活动。国家科技计划是国家解决社会和经济发展中涉及的重大科技问题、实现科技资源合理配置的重要手段。 |

| Article 3. The management of state science and technology plans shall comply with the following basic principles: | | 第三条 国家科技计划管理应遵循以下基本原则： |
| |
|
| 1) The formulation, implementation and management of state science and technology plans must be conducted according to law; | | （一）制定、实施和管理国家科技计划必须依法进行； |
| |
|
| 2) The establishment and choices of project of state science and technology plans must ensure the realization of state objectives; | | （二）国家科技计划设立和项目选择必须保证国家目标的实现； |
| |
|
| 3) Simplify management procedures, strengthen the research of policies, systems and rules of the management of state science and technology plans, and improve the efficiency of the management of state science and technology plans; and | | （三）简化管理程序，加强国家科技计划管理的政策、制度和规律研究，提高国家科技计划管理的效率； |
| |
|
| 4) Establish the open management system of state science and technology plans, promote the understanding and participation of the public in the management of state science and technology plans, and enhance the publicity and equity of the management and decision-making. | | （四）建立国家科技计划的管理公开制度，促进公众对国家科技计划管理的了解和参与，提高管理决策的公开性和公正性。 |

| Article 4. These rules apply to: | | 第四条 本规定适用于： |
| |
|
| 1) State plans of the research and development of high tech (Plans 863), key task plans of science and technology, basic research plans, construction plans for research and development capacity and conditions, construction plans of environment for the industrialization of science and technology and other plans involved in the state science and technology plan system and funded mostly by the central finance; and | | （一）涉及国家科技计划体系中以中央财政投入为主的国家高技术研究发展计划（８６３计划）、科技攻关计划、基础研究计划、研究开发能力条件建设计划、科技产业化环境建设环境等； |

| 2) State science and technology plans newly established according to the needs of national economy and social development. | | （二）根据国民经济和社会发展需要而新设立的国家科技计划。 |

| Chapter 2. Establishment of State Scientific and Technological Plans | | 第二章 国家科技计划的设立 |
| |
|
| Article 5. In accordance with state strategies of the development of science and technology and planning of the development of science and technology, and in the light of the actual demands of national economy, social development and state safety to science and technology, the Ministry of Science and Technology shall make proposals to the State Council at proper time to establish state science and technology plans that need the support of the newly added funds of the central finance. | | 第五条 科技部根据国家科技发展战略、科技发展规划，结合国民经济和社会发展以及国家安全等对科技的现实需求，适时向国务院提出需由中央财政新增经费支持而设立的国家科技计划的建议。 |

| Article 6. After relevant departments of the State Council, local administrative departments in charge of science and technology, and authoritative experts in science, technology, and economy are organized to discuss and consult the proposals of the establishment of state science and technology plans, the Ministry of Science and Technology shall draw up the draft of suggestion report on the establishment of state science and technology plans. The draft of proposal report on the establishment of state science and technology plans shall meet the following basic requirements: | | 第六条 科技部应当在组织国务院有关部门、地方科技行政管理部门和科技界、经济界权威专家对国家科技计划建议讨论和咨询后，起草设立国家科技计划的建议报告草案。 |

国家科技计划的建议报告草案应当符合以下基本要求： |
| |
|
| 1) The objective, task and emphasis of the state science and technology plans to be established must coordinate the overall disposition and arrangements of national economy and social development, and must meet the requirements of the state industrial policies and scientific and technological policies; | | （一）拟设立的国家科技计划目标、任务和重点必须与国民经济和社会发展的总体部署和安排相协调，并符合国家产业政策、科技政策的要求； |
| |
|
| 2) The draft shall clearly define the purpose, objective, task, scope, content, management and operation of the state science and technology plans, and explain the relationship between that plan and other state science and technology plans. | | （二）应对国家科技计划的宗旨、目标、任务、范围、内容、管理和运行等明确地予以界定，并说明该计划同现有的其他国家科技计划的关系； |
| |
|
| 3) The draft shall provide the fund budget of that plan, including the fund scale needed and the fund source, and shall explain the implementation term (circle) of that plan; and | | （三）应提供该计划的资金预算，包括所需要的资金规模和资金来源，并说明该计划的实施期限（周期）； |
| |
|
| 4) The draft shall provide the analysis of the development trend of technologies of correlative areas and relevant background information. | | （四）应提供该计划相关领域的技术发展趋势分析和有关背景资料。 |

| Article 7. The Ministry of Science and Technology shall submit the draft of proposal report to the high consultative committee which is participated by experts in science and technology, economy and management, and is independent of administrative departments, after the high consultative committee has consulted, deliberated and approved the draft, the Ministry of Science and Technology shall submit it to the State Council for ratification according to procedures. The experts participate in the high consultative committee shall be appointed by the Ministry of Science and Technology. | | 第七条 科技部应将建议报告草案提交由科技、经济和管理专家参加的、独立于行政管理部门的高层咨询委员会咨询，经高层咨询委员会对建议报告草案咨询审议并通过后，由科技部按程序报送国务院批准。 |

Article 8. A state science and technology plan shall have relative stability during the plan cycle, and major revisions of its purpose, objective and task as well as its cancellation or its change of name shall be submitted to the State Council for ratification after being deliberated by the Ministry of Science and Technology.
