Opinions on Strengthening the Work on Providing Legal Aid to Disabled Persons | |
关于加强残疾人法律救助工作的意见 |
The Party and the state attach great importance to the work on providing legal aid to disabled persons. On March 28, 2008, the Opinions of the CPC Central Committee and the State Council on Promoting the Development of the Cause of Disabled Persons (No.7 [2008] of the CPC Central Committee) pointed out that “we shall set up a legal aid system for disabled persons and do a good job in providing legal services, legal aid and judicial relief to disabled persons. We shall make more efforts in investigating cases about infringing upon the legitimate rights and interests of disabled persons and giving corresponding punishments.” On April 24, 2008, the Law of the People's Republic of China on the Protection of Disabled Persons was amended and adopted at the 2nd Session of the Standing Committee of the 11th National People's Congress, which strengthened the functions of the relevant entities and departments in protecting the rights and interests of disabled persons and specified the relevant contents about providing legal aid to disabled persons. The “Eleventh Five-Year” Outline for the Development of the Cause of Disabled Persons which was approved and forwarded by the State Council required to establish a legal aid system for disabled persons to solve the actual difficulties of disabled persons. The Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security, the Ministry of Justice, the Ministry of Civil Affairs, the Ministry of Human Resources and Social Security, the Ministry of Education, the Ministry of Health and China Disabled Persons' Federation jointly formulated and issued the “Eleventh Five-Year” Plan on Providing Legal Aid to Disabled Persons and the Measures for the Implementation of the “Eleventh Five-Year” Plan on Providing Legal Aid to Disabled Persons, which expressly stipulated the tasks, objectives and major measures of the work on providing legal aid to disabled persons during the “eleventh five-year” period, specified the functions and duties of all competent entities and departments in the said work and established a firm basis for the smooth proceeding of the legal aid work. On June 26, 2008, the Third Session of the Standing Committee of the 11th National People's Congress ratified China's acceding to the Convention on the Rights of Persons with Disabilities (UN) which requests the contracting states to take effective measures to make sure that disabled persons are under equal judicial protection. To effectively protect the legitimate rights and interests of disabled persons, do a good job in providing legal aid to them and make sure that they have access to legal aid services, we hereby put forward the following opinions: | |
党和国家高度重视残疾人法律救助工作。2008年3月28日，《中共中央国务院关于促进残疾人事业发展的意见》（中发〔2008〕7号）中指出：“建立残疾人法律救助体系，做好残疾人法律服务、法律援助、司法救助工作。加大对侵害残疾人合法权益案件的查处力度。”2008年4月24日，十一届全国人大常委会第二次会议通过修订后的《中华人民共和国残疾人保障法》，强化了相关单位和部门维护残疾人权益的职责，规定了残疾人法律救助的相关内容。国务院批转的《中国残疾人事业“十一五”发展纲要》中要求建立残疾人法律救助体系，解决残疾人的实际困难。最高人民法院、最高人民检察院、公安部、司法部、民政部、劳动和社会保障部、教育部、卫生部、中国残联联合制定下发《残疾人法律救助“十一五”实施方案》及《〈残疾人法律救助“十一五”实施方案〉实施办法》，明确规定了“十一五”期间残疾人法律救助工作的任务目标和主要措施，明确了各相关单位和部门的法律救助职责，为残疾人法律救助工作的顺利开展奠定了坚实基础。2008年6月26日，十一届全国人大常委会第三次会议批准我国加入联合国《残疾人权利公约》，该公约要求缔约国采取有效措施，保障残疾人获得平等司法保护。为切实维护残疾人的合法权益，进一步做好残疾人法律救助工作，使残疾人能够切实获得法律救助服务，提出以下意见： |

| I. Fully Understanding the Significance of Providing Legal Aid to Disabled Persons from the Perspective of Building a Socialist Harmonious Society | | 一、从构建社会主义和谐社会的高度，充分认识开展残疾人法律救助工作的重要意义 |
China has 83 million disabled persons that involve 260 million of family population. The group of disabled persons involves a large population, has a prominent characteristic and needs particular attention and assistance. The Party and the Central Government are always concerned for disabled persons, attach great importance to the cause of disabled persons and, especially after the reform and opening-up, have taken a series of big steps which promote the continuous development of the cause of disabled persons, improve the environment and conditions for disabled persons to get involved in social activities, improve their legal consciousness and strengthen their capability for protecting their own rights and interest. However, their weak position in the society has not been changed fundamentally, and they are still the most difficult group among all weak groups. The overall living situations of disabled persons still lag far behind the average level. Cases about discriminating against disabled persons or infringing upon their rights and interests occur from time to tome. It is still very difficult for many disabled persons to get the information they need, hire lawyers, engage in lawsuits and pay legal cost. We still have a long way to go before sufficiently meeting their demands for legal services. Protecting the rights and interests of disabled persons is still a fundamental and long-term task in the development of the cause of disabled persons. | |
我国有8300多万残疾人，涉及2.6亿家庭人口。残疾人是一个数量众多、特性突出、特别需要帮助的社会群体。党和政府历来十分关心残疾人，高度重视发展残疾人事业，特别是改革开放以来，采取了一系列重大措施，推动残疾人事业不断发展壮大，残疾人参与社会生活的环境和条件明显改善，法律意识普遍提高，依法维护自身权益的能力显著增强。但是，残疾人在社会中的弱势地位并未得到根本改变，他们仍然是社会弱势群体中最为困难的群体。残疾人的总体生活状况与社会平均水平仍然存在较大差距，歧视残疾人、侵害残疾人权益的现象时有发生，许多残疾人仍然面临着咨询难、请律师难、打官司难、无力支付法律服务费用等问题，残疾人的法律服务需求还不能得到充分有效满足，依法维护残疾人权益依然是残疾人事业发展中一项根本而长远的任务。 |
Providing legal aid to disabled persons is an important content of building a socialist harmonious society. The CPC Central Committee decided the important strategic task of building a socialist harmonious society after considering the overall arrangements in building socialism with Chinese characteristics and the overall situation of the work on building a well-off society in an all-round way. The first principle for building a socialist harmonious society lies in taking the people as the foremost, which means that the fundamental interests of the overwhelming majority of the people shall be always taken as the starting point and ultimate goal of all work of the Party and the state and all efforts shall be made to realize, protect and develop the fundamental interests of the overwhelming majority of the people. The group of disabled persons is the most difficult group out of all weak groups, the protection of their rights and interests is of great significance to the building of a socialist harmonious society. Providing legal aid services to disabled persons is a scientific and effective method to protect the rights and interests of disabled persons and is good for giving full play to the functions and roles of judicial relief, legal aid and legal services of the state so that disabled persons can enjoy more and better low-threshold legal services. Effectively protecting the legitimate rights and interests of disabled persons and providing legal aid services to them are important contents of building a socialist harmonious society. | |
为残疾人提供法律救助服务是构建社会主义和谐社会的一项重要内容。党中央从中国特色社会主义事业总体布局和全面建设小康社会全局出发，提出了构建社会主义和谐社会的重大战略任务。构建社会主义和谐社会的首要原则是以人为本，始终把最广大人民的根本利益作为党和国家一切工作的出发点和落脚点，实现好、维护好、发展好最广大人民的根本利益。残疾人作为社会弱势群体中最为困难的群体，其权益保障状况对社会主义和谐社会建设具有非常重要的意义。为残疾人提供法律救助服务，是依法维护残疾人权益的科学方法和有效手段，有助于充分发挥国家司法救助、法律援助、法律服务的功能和作用，使残疾人享受服务门槛更低、服务内容更多、服务范围更广的法律服务。切实保障残疾人的合法权益、为残疾人提供法律救助服务是构建社会主义和谐社会的一项重要内容。 |
At present, China is at a critical period of reform and development as the economic structure, social structure, interests structure and people's ideology all change profoundly. These unprecedented social changes bring along contradictions and problems as many as opportunities for development and progress. Disabled persons are less able to withstand risks and protect their own rights and interests, and there are very limited ways for them to do so, so they have more difficulties and obstacles than others in the face of economic and social changes. Providing legal aid services for disabled persons is a requisite for building a socialist harmonious society, a reflection of the philosophy of administering state affairs by law and the cause of protecting human rights in the work on disabled persons, and a way for improving disabled persons' awareness and ability of protecting their own rights and interests. It can give more opportunities for disabled persons to enjoy the achievements in economic and social development as well as reform and opening-up. The people's courts, people's procuratorates, public security departments, judicial administrative departments, civil affairs departments, human resources and social security departments, education departments, health departments and disabled persons' federations at all levels shall deepen their understanding about the work on providing legal aid to disabled persons, put the work on agenda, and promulgate effective policies and measures so as to carry out the work in an in-depth way. | |
目前，我国正处在改革发展的关键时期，经济体制深刻变革，社会结构深刻变动，利益格局深刻调整，思想观念深刻变化。这种空前的社会变革，给我国发展进步带来巨大活力的同时，也必然带来这样那样的矛盾和问题。残疾人抵御风险的能力较低，保障自身权益的能力和途径有限，因此残疾人在经济变革和社会变动中比其他人面临更多的困难和障碍。为残疾人提供法律救助服务，是社会主义和谐社会建设的一项必然要求，是依法治国理念和人权保障事业在残疾人工作领域的生动体现，能够提高残疾人依法保障权益的意识和能力，使残疾人充分享受经济社会发展和改革开放成果。各级人民法院、人民检察院、公安、司法行政、民政、人力资源社会保障、教育、卫生、残联等单位和部门要切实提高对残疾人法律救助工作的认识，把残疾人法律救助工作纳入重要工作议程，出台相关政策和有效措施，推进残疾人法律救助工作的深入开展。 |
