The higher people's courts and trade union federations of Inner Mongolia Autonomous Region, Jilin Province, Shanghai Municipality, Zhejiang Province, Jiangxi Province, Shandong Province, Hubei Province, Guangdong Province, Guangxi Zhuang Autonomous Region, Sichuan Province, and Shaanxi Province: 内蒙古、吉林、上海、浙江、江西、山东、湖北、广东、广西、四川、陕西省(自治区、直辖市)高级人民法院、总工会:
For the purposes of thoroughly implementing the spirit of the 19th CPC National Congress and the Second, Third, and Fourth Plenary Sessions of the 19th CPC Central Committee, actively implementing the new requirements for improving the comprehensive mechanism for diversified prevention, mediation, and resolution of social conflicts and disputes, further advancing the construction of a diversified resolution mechanism for labor disputes, building harmonious labor relations, and promoting both decent work and comprehensive development of the majority of workers, the Supreme People's Court and the All China Federation of Trade Unions have decided to implement the pilot program of diversified resolution of labor disputes in Inner Mongolia Autonomous Region, Jilin Province, Shanghai Municipality, Jiangxi Province, Shandong Province, Hubei Province, Guangdong Province, Sichuan Province, and other provinces (autonomous regions and municipalities directly under the central government), Xi'an City in Shaanxi Province, Ningbo City in Zhejiang Province, and Beihai City in Guangxi Zhuang Autonomous Region according to the Trade Union Law of the People's Republic of China, the Labor Law of the People's Republic of China, the Labor Dispute Mediation and Arbitration Law of the People's Republic of China, the Opinions of the General Office of the CPC Central Committee and the General Office of the State Council on Improving the Mechanism for Diversified Resolution of Disputes (No. 60 [2015], General Office of the CPC Central Committee), and the Opinions of the Supreme People's Court on Improving the Mechanism for Diversified Resolution of Conflicts (No. 14 [2016], SPC). The following opinions are hereby put forward: 为全面贯彻党的十九大和十九届二中、三中、四中全会精神,积极落实完善社会矛盾纠纷多元预防调处化解综合机制新要求,深入推进劳动争议多元化解机制建设,构建和谐劳动关系,促进广大劳动者实现体面劳动、全面发展,根据《中华人民共和国工会法》《中华人民共和国劳动法》《中华人民共和国劳动争议调解仲裁法》,以及中共中央办公厅、国务院办公厅《关于完善矛盾纠纷多元化解机制的意见》(中办发〔2015〕60号)和最高人民法院《关于人民法院进一步深化多元化纠纷解决机制改革的意见》(法发〔2016〕14号),最高人民法院和中华全国总工会决定在内蒙古、吉林、上海、江西、山东、湖北、广东、四川等省(自治区、直辖市),以及陕西省西安市、浙江省宁波市和广西壮族自治区北海市开展劳动争议多元化解试点工作。现提出如下意见:
1. Significance of the pilot program: As a pragmatic measure for insisting on and improving the social governance system for joint establishment, joint governance and sharing, maximizing the role of trade unions in participating in the negotiation and mediation of labor disputes, maximizing the role of people's courts in leading, promoting and guaranteeing the reform of the diversified dispute resolution mechanism, and putting the non-litigation dispute resolution mechanism at the forefront, implementation of the pilot program of diversified resolution of labor disputes is conducive to the lawful protection of the legal rights and interests of workers in accordance with the law. Implementation of the pilot program is also conducive to active prevention and appropriate resolution of major risks in the field of labor relations, optimization of the law-based business environment, and maintenance of harmonious labor relations and social stability. 1.试点工作意义。开展劳动争议多元化解试点工作,是坚持和完善共建共治共享的社会治理制度,充分发挥工会参与劳动争议协商调解职能作用,发挥人民法院在多元化纠纷解决机制改革中的引领、推动、保障作用,切实将非诉讼纠纷解决机制挺在前面的务实举措,有利于依法维护广大职工合法权益,积极预防和妥善化解劳动关系领域重大风险,优化法治营商环境,维护劳动关系和谐与社会稳定。
2. Promoting the diversified resolution of labor disputes: The people's courts and trade union federations at all levels shall strengthen work coordination, and actively promote the establishment and improvement of a mechanism for the prevention and resolution of labor disputes which is led by the party committees, dominated by the government, and jointly participated in by all departments and organizations. Parties to a dispute shall be encouraged and directed to resolve disputes through consultation, mediation, arbitration and other non-litigation methods, and strengthen the participation of trade unions in the interaction between labor dispute mediation and arbitration mediation, people's mediation and judicial mediation, to gradually realize transition of procedures, integration of resources, and sharing of information, and also to promote the formation of a new pattern of diversified resolution of labor disputes.

 2.推进劳动争议多元化解。各级人民法院和总工会要加强工作协同,积极推动建立完善党委领导、政府主导、各部门和组织共同参与的劳动争议预防化解机制。鼓励和引导争议双方当事人通过协商、调解、仲裁等非诉讼方式解决纠纷,加强工会参与劳动争议调解工作与仲裁调解、人民调解、司法调解的联动,逐步实现程序衔接、资源整合、信息共享,推动形成劳动争议多元化解新格局。
