Human resources and social security departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, and Xinjiang Production and Construction Corps; and human resources and social security bureaus of all sub-provincial cities: 各省、自治区、直辖市及新疆生产建设兵团人力资源社会保障厅(局),各副省级市人力资源社会保障局:
For purposes of further regulating activities in the human resources market, severely cracking down on violations of the laws and regulations, maintaining the fair-competition, regularized, and orderly order of the human resources market, effectively protecting the lawful rights and interests of laborers and employers, causing the market in playing a better role in allocating human resources, and creating a good market environment for promoting employment and entrepreneurship, the following opinions are hereby offered on further regulating the order of the human resources market: 为进一步规范人力资源市场活动,严厉打击违法违规行为,维护公平竞争、规范有序的人力资源市场秩序,切实保障劳动者和用人单位合法权益,更好发挥市场在人力资源配置中的作用,为促进就业创业营造良好市场环境,现就进一步规范人力资源市场秩序提出以下意见:
I. Strengthening routine supervision and administration   一、加强日常监督管理
1. Regulating activities in the human resources market in accordance with the law. The implementation of the Interim Regulation on the Human Resources Market shall be effectively ensured, and the rights, obligations, and conduct such as laborers' seeking employment, recruitment by employers, and the supply of services by human resources service institutions shall be regulated in accordance with the law. Employees' seeking employment honestly shall be advocated, and basic personal information shall be provided faithfully for employers and human resources service institutions. Employers shall be supervised conducting recruitment work according to the law, faithfully releasing or providing employment information according to the law, which shall not contain discriminatory content, comply with the provisions of the laws and regulations in service period, restrictions on employment, confidentiality, and other aspects, and protect the lawful rights and interests of laborers. Human resources service institutions shall be promoted in operating according to the law and providing services honestly, and may neither resort to fraud, violence, coercion, or otherwise illicit means nor procure an entity or individual to engage in illegal activities; and human resources service institutions shall comply with corresponding standards of practice when organizing physical job fairs, collecting and releasing information on human resources supply and demand, providing human resources services by outsourcing, conducting staffing business, and providing human resources services and other services through the Internet. Human resources and social security authorities at all levels shall ensure the effective implementation of the regulation of the activities of market participants and punish violations of the laws and regulations based on corresponding legal liability. (一)依法规范人力资源市场活动。切实抓好《人力资源市场暂行条例》贯彻实施工作,依法规范劳动者求职、用人单位招聘、人力资源服务机构提供服务等权利义务和行为。倡导劳动者诚实求职,向用人单位和人力资源服务机构如实提供个人基本信息。监督用人单位依法开展招聘工作,依法如实发布或者提供招聘信息,不得含有歧视性内容,遵守法律法规对服务期、从业限制、保密等方面的规定,保障劳动者合法权益。推动人力资源服务机构依法经营、诚信服务,不得采取欺诈、暴力、胁迫或者其他不正当手段,不得介绍单位或者个人从事违法活动;人力资源服务机构举办现场招聘会、开展人力资源供求信息的收集和发布、提供人力资源服务外包、开展劳务派遣业务、通过互联网提供人力资源服务等服务活动,应当遵守相应的活动准则。各级人力资源社会保障部门要确保市场主体活动规范落实到位,对违法违规行为,要按照相应的法律责任进行惩处。
2. Strengthening market access administration. Human resources and social security authorities at all levels shall implement staffing business license and human resources service license and filing systems in accordance with the law and establish and improve service journals for administration of human resources service institutions, so as to lay a solid foundation for the implementation of interim and ex-post regulation. Human resources and social security authorities at all levels shall improve the communication mechanism with the market regulatory authorities and cooperate with market regulatory authorities in specifying the correlation between the scope of business and items under business license, so as to regulate the connection between the scope of business and items under business license of human resources service institutions. Human resources and social security authorities at all levels shall implement the matters of "business licenses before government permits," fulfill the working requirements that a market regulatory authority push information on any market participant whose scope of business covers human resources services to the human resources and social security authority and so notify as to enable the human resources service institution to voluntarily make a license filing to the human resources and social security authority, vigorously claim and utilize information on market participants pushed by market regulatory authorities, supervise and guide enterprises' timely application for business license, and avoid a blind spot concerning routine regulation and enforcement actions. Human resources and social security authorities shall, when implementing the matters of "business licenses before government permits," promptly notify market regulatory authorities of license-related information on market participants to achieve precision information sharing between departments. Human resources and social security authorities shall strengthen communication and connection between administrative license and labor security enforcement action, establish and implement an information exchange mechanism within the human resources and social security authorities (between licensing departments and labor security enforcement departments) with respect to relevant license information, lawfully suspend the licenses of violators of the relevant provisions of the laws and regulations with serious circumstances, establish a normal market exit mechanism, and join regulatory forces. (二)加强市场准入管理。各级人力资源社会保障部门要依法实施劳务派遣经营许可、人力资源服务许可和备案制度,建立完善人力资源服务机构管理服务台账,为实施事中事后监管奠定坚实基础。健全完善与市场监管部门的信息沟通机制,配合市场监管部门明确经营范围与经营许可事项的对应关系,规范人力资源服务机构经营范围登记与经营许可的衔接。实行“先照后证”的事项,落实市场监管部门将经营范围涉及人力资源服务业务的市场主体信息推送至人社部门、告知人力资源服务机构在取得营业执照后应主动向人社部门依法许可备案的“双告知”工作要求,积极认领和利用市场监管部门推送的市场主体信息,督促指导企业及时办理经营许可,避免出现日常监管和执法盲区。实行“先证后照”的事项,人力资源社会保障部门应及时将市场主体许可相关信息告知市场监管部门,实现部门间精准化信息共享。加强行政许可与劳动保障监察执法之间的沟通衔接,建立并实施有关许可信息在人社部门内部(许可机构与劳动保障监察执法机构)的信息交换机制,对违反法律法规有关规定情节严重的,要依法吊销其许可证,建立正常市场退出机制,形成监管合力。
3. Improving the annual reports publication system. Authorities having jurisdiction over the human resources market and those having jurisdiction over staffing entities at all levels shall research and develop specific rules and procedures and improve the system by which human resources service institutions submit annual reports to appropriate authorities on schedule and publish business information. Human resources service institutions shall be promoted in effectively performing their statutory obligations to publicly disclose information and data related to their production and operation activities in accordance with the law, so as to strengthen social supervision and coordinated co-governance. Human resources and social security authorities shall conduct inspection according to the law, or verify the annual reports and published information of human resources service institution according to reports and impose punishment in accordance with the laws and regulations on human resources service institutions that fail to submit annual reports as required, refuse to perform the obligation to publish information, or commit conduct such as concealment and fabrication. Human resources and social security authorities shall publicly disclose the relevant contents of annual reports including human resources service institutions' names, business addresses, legal representatives, scope of service, contact information, establishment of branch offices, website addresses, administrative license and filing and their modification and extension, and administrative punishment, so as to accept social supervision. (三)完善年度报告公示制度。各级人力资源市场管理部门、劳务派遣单位管理部门要研究制定具体规程,完善人力资源服务机构按期向主管部门报送年度报告、向社会公示业务开展情况的制度。促进人力资源服务机构切实履行依法公开生产经营活动有关信息数据的法定义务,增强社会监督和协同共治。人力资源社会保障部门依法开展检查,或根据举报核查人力资源服务机构年度报告及公示信息,对未按规定报送年度报告、拒绝履行信息公示义务以及存在隐瞒情况、弄虚作假等行为的人力资源服务机构,依法依规作出处理。对人力资源服务机构名称、营业地址、法定代表人、服务范围、联系方式、设立分支机构、网站网址以及行政许可和备案及其变更、延续、行政处罚情况等年度报告有关内容,要向社会公布,接受社会监督。
4. Strengthening the administration of recruitment activities. Human resources and social security authorities at all levels shall strictly administer physical job fairs in accordance with the law, and may implement the ex-ante reporting and filing system based on actual circumstances, so as to guide and supervise and enable human resources service institutions to develop organization and implementation measures, emergency plans, and safety protection work plans, verify the authenticity and legality of participants in the job fairs and their job ads, release information on the job fairs to the public in advance, effectively conduct safety inspection on venues for the job fairs, and implement safety responsibility. Human resources and social security authorities at all levels shall regulate online recruitment activities according to the law, so as to guide and supervise and enable online employment platforms to establish and improve an information release and review system and perform the obligation to release and review information according to the law, strengthen the qualification of employers and the real-name authentication of persons releasing information, regulate procedures for information releasing, and ensure the authenticity, legality, and validity of information released. Human resources and social security authorities at all levels shall guide and supervise and enable online recruitment platforms to establish and improve a complaint processing mechanism, publish complaining and reporting methods in the conspicuous position of their websites, and conduct timely investigation and processing upon receipt of complaints and reports, and, upon discovering that an employer or an enterprise client publishes false information or information containing anything discriminatory, gives inflating publicity, has no relevant qualification, or otherwise violates the laws and regulations, suspend or terminate the services provided it, with an immediate report made to the relevant supervision and administration authorities.

 (四)强化招聘活动管理。各级人力资源社会保障部门要依法严格现场招聘会管理,可结合实际实施事前报告备案制度,指导和督促人力资源服务机构制定组织实施办法、应急预案和安全保卫工作方案,核实参加招聘会单位及其招聘简章的真实性、合法性,提前将招聘会信息向社会公布,切实做好招聘会场地安全检查工作,落实安全责任。要依法规范网络招聘活动,指导和督促网络招聘平台建立完善信息发布审查制度,依法履行信息发布审核义务,加强对招聘单位的资质认证和信息发布人员的实名认证,规范信息发布流程,确保发布的信息真实、合法、有效。指导和督促网络招聘平台建立完善投诉处理机制,在网站明显位置公布投诉举报方式,接到投诉举报要及时进行调查处理,发现招聘单位或入驻平台的企业发布虚假信息或含有歧视性内容信息、夸大宣传、不具备相关资质以及有其他违法违规行为的,应当暂停或终止为其提供服务,并立即向相关监督管理部门报告。
