Chapter I General Provisions 

第一章 总则


 
Article 1 These Measures are enacted in accordance with the Urban Real Estate Administration Law of the People's Republic of China with a view to strengthening the administration of urban house title, maintaining the real estate market order, and guarantee the lawful rights and interests of the right-holders of houses.   第一条 为加强城市房屋权属管理,维护房地产市场秩序,保障房屋权利人的合法权益,根据《中华人民共和国城市房地产管理法》的规定,制定本办法。

 
Article 2 These Measures shall be applicable to the registration of title of houses in the State-owned land within a planned urban district.   第二条 本办法适用于城市规划区国有土地范围内的房屋权属登记。

 
Article 3 The registration of house title mentioned in these Measures shall refer to the acts of the administrative department in charge of real estate who represents the government to register the house ownership as well as other rights to the house such as mortgage, the right to pawn, etc. derived from the above said rights, and to confirm the house ownership relations in accordance with the law.   第三条 本办法所称房屋权属登记,是指房地产行政主管部门代表政府对房屋所有权以及由上述权利产生的抵押权、典权等房屋他项权利进行登记,并依法确认房屋产权归属关系的行为。

The right-holder of a house mentioned in these Measures (hereinafter referred to as the right-holder) shall refer to a legal person, any other organization or a natural person who shall, in accordance with the law, enjoy the house ownership as well as the land use right of the house site and other rights to real estate.
 
本办法所称房屋权利人(以下简称权利人),是指依法享有房屋所有权和该房屋占用范围内的土地使用权、房地产他项权利的法人、其他组织和自然人。

The applicant for the rights to a house mentioned in these Measures (hereinafter referred to as the applicant) shall refer to a legal person, any other organization or a natural person who has obtained the house and filed an application for the house registration, but has not obtained the certificate of house ownership.
 
本办法所称房屋权利申请人(以下简称申请人),是指已获得了房屋并提出房屋登记申请,但尚未取得房屋所有权证书的法人、其他组织和自然人。

 
Article 4 The State shall practice a system of registration and certification of the house ownership.   第四条 国家实行房屋所有权登记发证制度。

The applicant shall, in accordance with the relevant provisions of the State, apply to the administrative department in charge of real estate under the people's government (hereinafter referred to as the registration organ) at the locality of the house, for the registration of the house title, and shall obtain the certificate of house title.
 
申请人应当按照国家规定到房屋所在地的人民政府房地产行政主管部门(以下简称登记机关)申请房屋权属登记,领取房屋权属证书。

 
Article 5 The certificate of house title shall be the only lawful document on the basis of which the right-holder shall, in accordance with the law, have the ownership of the house, i.e. the rights to possess, utilize, profit from and dispose of the house.   第五条 房屋权属证书是权利人依法拥有房屋所有权并对房屋行使占有、使用、收益和处分权利的唯一合法凭证。

The rights to a house registered in accordance with the law shall be protected by the State law.
 
依法登记的房屋权利受国家法律保护。

 
Article 6 The registration of house title shall comply with the principle that the subject of the house ownership shall be in conformity with that of the land use right of the house site.   第六条 房屋权属登记应当遵循房屋的所有权和该房屋占用范围内的土地使用权权利主体一致的原则。

 
Article 7 Where a department under the local people's government at the county level or above is in charge of both housing administration and land administration, the said department may make and issue the uniform certificate of the real estate ownership, in which the confirmation and modification of the house ownership and the land use right of the house site shall be recorded respectively in accordance with the Law on the Administration of the Urban Real Estate. The sample of the certificate of the real estate ownership shall be submitted to the administrative department in charge of construction under the State Council for record.   第七条 县级以上地方人民政府由一个部门统一负责房产管理和土地管理工作的,可以制作、颁发统一的房地产权证书,依照《城市房地产管理法》的规定,将房屋的所有权和该房屋占用范围内的土地使用权的确认和变更,分别载入房地产权证书。房地产权证书的式样报国务院建设行政主管部门备案。

 
Article 8 The administrative department in charge of construction under the State Council shall be responsible for the administration of the registration of house title throughout the country.   第八条 国务院建设行政主管部门负责全国的房屋权属登记管理工作。

The administrative department in charge of construction under the people's government of a province or autonomous region shall be responsible for the administration of the registration of house title within its own administrative area.
 
省、自治区人民政府建设行政主管部门负责本行政区域内的房屋权属登记管理工作。

The administrative department in charge of real estate under the people's government of a municipality directly under the Central Government, a city or a county shall be responsible for the administration of the registration of house title within its own administrative area.
 
直辖市、市、县人民政府房地产行政主管部门负责本行政区域内的房屋权属登记管理工作。

 
Chapter II Registration of House Title 

第二章 房屋权属登记


 
Article 9 The registration of house title can be divided into:   第九条 房屋权属登记分为:

 
(1) general registration; (一)总登记;

 
(2) primary registration; (二)初始登记;

 
(3) transfer registration; (三)转移登记;

 
(4) modification registration; (四)变更登记;

 
(5) registration of other rights; (五)他项权利登记;

 
(6) cancellation registration. (六)注销登记。

 
Article 10 The registration of house title shall be carried out in accordance with the following procedures:   第十条 房屋权属登记依以下程序进行:

 
(1) accepting the application for registration; (一)受理登记申请;

 
(2) checking the title; (二)权属审核;

 
(3) making an announcement; (三)公告;

 
(4) approving the registration and issuing the certificate of house title. (四)核准登记,颁发房屋权属证书。

Item (3) of this Article shall be applicable to the registration that the registration organ considers necessary to be announced.
 
本条第(三)项适用于登记机关认为有必要进行公告的登记。

 
Article 11 The registration of house title shall be applied for by the right-holder (the applicant). Where the right-holder (the applicant) is a legal person or any other organization, it shall use its legal name, and the registration shall be applied for by its legal representative.   第十一条 房屋权属登记由权利人(申请人)申请。权利人(申请人)为法人、其他组织的,应当使用其法定名称,由其法定代表人申请;

Where the right-holder (the applicant) is a natural person, he shall use the name in its identification certificate.
 
权利人(申请人)为自然人的,应当使用其身份证件上的姓名。

Where a house is jointly owned by co-owners, the registration shall be jointly applied for by the co-owners.
 
共有的房屋,由共有人共同申请。

The registration of other rights to a house shall be jointly applied for by both the right-holder and the right-holder of other rights.
 
房屋他项权利登记,由权利人和他项权利人共同申请。

The registration organ shall represent the administrative department in charge of real estate to directly register a public house directly managed by the latter.
 
房地产行政主管部门直管的公房由登记机关直接代为登记。

 
Article 12 The right-holder (the applicant) may entrust an agent to apply for the registration of house title.   第十二条 权利人(申请人)可以委托代理人申请房屋权属登记。

 
Article 13 The right-holder (the applicant) shall, when applying for the registration, submit the relevant effective certificates of the entity or of the relevant person to the registration organ for check.   第十三条 权利人(申请人)申请登记时,应当向登记机关交验单位或者相关人的有效证件。

The agent shall, when applying for the registration, submit the right-holder's (the applicant's) written power of attorney to the registration organ in addition to submitting his own relevant effective certificates to the registration organ for check.
 
代理人申请登记时,除向登记机关交验代理人的有效证件外,还应当向登记机关提交权利人(申请人)的书面委托书。

 
Article 14 The general registration shall refer to the uniform registration of house title carried out by the local people's government at the county level or above, when necessary, within a certain time limit and within its administrative area.
