| For the purposes of further advancing the accomplishment of the overall objective of "basically resolving the problem of difficulties in enforcement in two to three years" and fully protecting the lawful rights and interests of parties, in consideration of the problems found in recent enforcement work, the relevant issues are hereby notified as follows: | | 为进一步推进“用两到三年时间基本解决执行难问题”整体目标的实现，充分保障当事人的合法权益，结合近期执行工作中发现的问题，现就有关问题通知如下： |
| I. Issues relating to the list of dishonest judgment debtors | | 一、关于失信被执行人名单相关问题 |
1. An enforcement court shall examine whether a judgment debtor falls under the statutory circumstances for the inclusion in the list, in strict accordance with the provisions of Article 1 of the Several Provisions of the Supreme People's Court on Issuing the Information on the List of Dishonest Judgment Debtors | | （一）执行法院应当严格依照《最高人民法院关于公布失信被执行人名单信息的若干规定》（法释[2017]7号，以下简称《失信规定》）第一条的规定审查被执行人是否符合纳入名单的法定情形，严禁将不符合条件的被执行人纳入失信名单。 |
| 2. If a judgment debtor falls under any of the circumstances as provided in Article 3 of the Provisions on Dishonesty, the judgment debtor may not be put on the list under paragraph 1, Article 1 of the Provisions on Dishonesty. If the judgment debtor has been put on the list, the judgment debtor shall be removed from the list, and the judgment debtor falls under any of the circumstances in Article 3 (1) and (2) of the Provisions on Dishonesty after the debtor has been put on the list, the listing shall be blocked. | | （二）具有《失信规定》第三条规定情形之一的，不得依据《失信规定》第一条第一项的规定将被执行人纳入失信名单。已经纳入的，应当撤销，纳入后才具有《失信规定》第三条第（一）、（二）项情形之一的，应当屏蔽。 |
| 3. For the listing information of a dishonest judgment debtor for a term, if the dishonest judgment debtor has completed enforcement, the dishonesty information shall be deleted in advance in accordance with the provisions of paragraph 2, Article 2 of the Provisions on Dishonesty, under the procedure as required by the Notice (No. 33 [2018], SPC). | | （三）对于有失信期限的失信被执行人名单信息，失信被执行人履行完毕的，应当依照《失信规定》第二条第二款的规定提前删除失信信息，具体操作按我院“法明传[2018]33号”通知要求进行。 |
| 4. When a case is closed by report by means of termination of the present enforcement procedure, and the enforcement court marks the case with actual closure, as required by the Notice (No. 699 [2017], SPC), if the listing information of the dishonest judgment debtor remains open, the listing shall be blocked; and if a dishonest judgment debtor is erroneously put on the list, the debtor shall be removed from the list. | | （四）案件已经以终结本次执行程序方式报结，执行法院按照我院“法明传[2017]699号”通知要求，已将案件标注为实结，尚有失信被执行人名单信息处于发布状态的，应当屏蔽；如果纳入失信被执行人名单错误的，应当撤销。 |
