The people's governments of all provinces, autonomous regions, municipalities directly under the Central Government, and cities under separate state planning; and Xinjiang Production and Construction Corps: 各省、自治区、直辖市及计划单列市人民政府,新疆生产建设兵团:
As a major force behind national economic and social development and an important foundation for building a modern economic system and promoting high-quality economic development, small and medium-sized enterprises provide important support for expanding employment and improving people's livelihood, hence an important birthplace of entrepreneurship. The CPC Central Committee and the State Council have given top priority to the development of small and medium-sized enterprises. In recent years, a series of policies and measures have been introduced, and the related work has thus achieved positive results. However, there are still some prominent problems, especially some basic institutional problems that urgently need to be solved. For the purposes of thoroughly implementing the spirit of the Fourth Plenary Session of the 19th CPC Central Committee, adhering to and improving the basic socialist economic system, unswervingly consolidating and developing the public sector and unswervingly supporting and developing the non-public sector, forming a long-term mechanism for providing regular support for the development of small and medium-sized enterprises, and promoting the high-quality development of small and medium-sized enterprises, with the approval of the State Council, the following opinions on improving the system of supporting the development of small and medium-sized enterprises are hereby offered. 中小企业是国民经济和社会发展的主力军,是建设现代化经济体系、推动经济高质量发展的重要基础,是扩大就业、改善民生的重要支撑,是企业家精神的重要发源地。党中央、国务院高度重视中小企业发展,近年来出台了一系列政策措施,有关工作取得积极成效,但仍存在一些突出问题,特别是一些基础性制度性问题亟待解决。为深入贯彻党的十九届四中全会精神,坚持和完善社会主义基本经济制度,坚持“两个毫不动摇”,形成支持中小企业发展的常态化、长效化机制,促进中小企业高质量发展,经国务院同意,现就健全支持中小企业发展制度,提出如下意见。
I. Improving the basic system for supporting the development of small and medium-sized enterprises   一、完善支持中小企业发展的基础性制度
1. The legal and regulatory systems for small and medium-sized enterprises shall be improved. On the basis of the Law on the Promotion of Small and Medium-sized Enterprises, the establishment of a legal and regulatory system with Chinese characteristics that supports the development of small and medium-sized enterprises and that protects their legitimate rights and interests shall be accelerated. Local governments shall be encouraged to develop local laws and regulations to promote the development of small and medium-sized enterprises. Efforts shall be made to explore ways of establishing an evaluation system for laws and regulations applicable to small and medium-sized enterprises and an inspection system for the implementation thereof, so as to supervise the implementation of laws and regulations. (一)健全中小企业法律法规体系。以《中小企业促进法》为基础,加快构建具有中国特色、支持中小企业发展、保护中小企业合法权益的法律法规体系。鼓励地方依法制定本地促进中小企业发展的地方法规。探索建立中小企业法律法规评估制度和执行情况检查制度,督促法律法规落实到位。
2. The system of fair competition shall be upheld. The market access negative list system shall be fully implemented. Small and medium-sized enterprises shall be fairly treated by removing unreasonable thresholds and restrictions so as to ensure equal rights, opportunities and rules for small, medium-sized and large enterprises and economic entities of all forms of ownership. The fair competition review system shall be fully implemented, and the review procedures and standards shall be improved. A complaint, publicity, and spot check system for fair competition review shall be established and improved. Law enforcement against monopoly and unfair competition shall be strengthened and improved to maintain the order of market competition. (二)坚持公平竞争制度。全面实施市场准入负面清单制度,公正公平对待中小企业,破除不合理门槛和限制,实现大中小企业和各种所有制经济权利平等、机会平等、规则平等。全面落实公平竞争审查制度,完善审查流程和标准,建立健全公平竞争审查投诉、公示、抽查制度。加强和改进反垄断和反不正当竞争执法,维护市场竞争秩序。
3. The statistical monitoring and release system for small and medium-sized enterprises shall be improved. The statistical monitoring system for small and medium-sized enterprises shall be improved, and statistical data on these enterprises shall be released on a regular basis. A statistical system for the financing of small and medium-sized enterprises shall be established, and an index measuring financial conditions of small and medium-sized enterprises shall be compiled. The structural analysis of small and medium-sized enterprises shall be strengthened to improve statistical monitoring and analysis. The use of big data and other means shall be explored to monitor and analyze the operation of small and medium-sized enterprises. The handbook of Major Statistics on Small and Medium-sized Enterprises shall be improved, and the compilation of an index of the development of small and medium-sized enterprises shall be studied. The standards for the classification of small and medium-sized enterprises shall be revised when appropriate. (三)完善中小企业统计监测和发布制度。健全中小企业统计监测制度,定期发布中小企业统计数据。建立中小企业融资状况调查统计制度,编制中小微企业金融条件指数。加强中小企业结构化分析,提高统计监测分析水平。探索利用大数据等手段开展中小企业运行监测分析。完善《中小企业主要统计数据》手册,研究编制中小企业发展指数。适时修订中小企业划型标准。
4. The credit system for small and medium-sized enterprises shall be improved. The "government plus market" model shall be upheld. A mechanism for collecting, sharing, and inquiring credit information on small and medium-sized enterprises shall be established and improved. The national credit information sharing platform shall be relied on to integrate and share various data on public services of enterprises in a timely manner. A credit evaluation system for small and medium-sized enterprises shall be established and improved, and the basic database of financial credit information shall be improved. Credit reference products for micro and small-sized enterprises shall be innovated to efficiently match financial services. The relevant laws and regulations shall be studied and introduced to regulate the collection, publicity and inquiry of credit information on small and medium-sized enterprises as well as credit supervision. The fundamental role of the National Enterprise Credit Information Publicity System shall be leveraged, and enterprise information shall be recorded under the name of the enterprise and publicized in accordance with the law. (四)健全中小企业信用制度。坚持“政府+市场”的模式,建立健全中小企业信用信息归集、共享、查询机制,依托全国信用信息共享平台,及时整合共享各类涉企公共服务数据。建立健全中小企业信用评价体系,完善金融信用信息基础数据库,创新小微企业征信产品,高效对接金融服务。研究出台有关法律法规,规范中小企业信用信息采集、公示查询和信用监管等。发挥国家企业信用信息公示系统的基础作用,将涉企信息记于企业名下并依法公示。
5. The fair regulatory system shall be improved. Regulatory matters shall be reduced, and the handling procedures shall be simplified. The whole-process online handling shall be promoted, and assistance shall be guided. Credit supervision and the reform of "Internet plus supervision” shall be comprehensively carried out. Hierarchical and cross-departmental supervision shall be promoted. Interim and ex-post supervision shall be strengthened and regulated. Inclusive and prudent oversight shall be strengthened and improved to avoid taking simple and crude measures against small and medium-sized enterprises. One-size-fits-all approaches shall be investigated and punished. (五)完善公正监管制度。减少监管事项,简化办事流程,推广全程网上办、引导帮办,全面推行信用监管和“互联网+监管”改革。推进分级分类、跨部门联合监管,加强和规范事中事后监管,落实和完善包容审慎监管,避免对中小企业采取简单粗暴处理措施,对“一刀切”行为严肃查处。
2. Upholding and improving the financial and taxation support system for small and medium-sized enterprises   二、坚持和完善中小企业财税支持制度
6. An accurate and effective financial support system shall be improved. The central finance shall set up an entry of small and medium-sized enterprises, and the finance authorities at the county level and above shall, according to their actual conditions, arrange for a special fund for supporting the development of small and medium-sized enterprises. A national incorporated fund of funds for the development of small and medium-sized enterprises shall be established. The fund management system and the market-based fund operation mechanism shall be improved to guide qualified local governments to establish funds for the development of small and medium-sized enterprises. The measures for the management of special funds shall be improved to strengthen fund performance evaluation. (六)健全精准有效的财政支持制度。中央财政设立中小企业科目,县级以上财政根据实际情况安排中小企业发展专项资金。建立国家中小企业发展基金公司制母基金,健全基金管理制度,完善基金市场化运作机制,引导有条件的地方政府设立中小企业发展基金。完善专项资金管理办法,加强资金绩效评价。
7. A long-term mechanism for easing tax and fee burdens on enterprises shall be established. Tax policies that are conducive to the development of micro and small-sized enterprises shall be implemented. Eligible micro and small-sized enterprises shall be subject to the deferment, reduction, and exemption of enterprise income tax and value-added tax and other measures, and the tax collection and administration procedures shall be simplified. Preferential policies such as reducing or exempting administrative fees shall be implemented for micro and small-sized enterprises to ease their tax burdens. The enterprise charge list system shall be effectively implemented to strengthen supervision and inspection of enterprise charges. Enterprise charges shall be reviewed and regulated. (七)建立减轻小微企业税费负担长效机制。实行有利于小微企业发展的税收政策,依法对符合条件的小微企业按照规定实行缓征、减征、免征企业所得税、增值税等措施,简化税收征管程序;对小微企业行政事业性收费实行减免等优惠政策,减轻小微企业税费负担。落实好涉企收费目录清单制度,加强涉企收费监督检查,清理规范涉企收费。
8. The policy mechanism for supporting small and medium-sized enterprises in government procurement shall be strengthened. The Interim Measures for Promoting the Development of Small and Medium-sized Enterprises through Government Procurement shall be revised, and measures such as reserving purchase shares, and giving preferential price reviews shall be improved so as to increase the share of small and medium-sized enterprises in government procurement. The procurement reserved from small and medium-sized enterprises shall account for more than 30% of the total budget of the department's annual government procurement project; to be specific, the proportion reserved for small and medium-sized enterprises shall be no less than 60%. (八)强化政府采购支持中小企业政策机制。修订《政府采购促进中小企业发展暂行办法》,完善预留采购份额、价格评审优惠等措施,提高中小企业在政府采购中的份额。向中小企业预留采购份额应占本部门年度政府采购项目预算总额的30%以上;其中,预留给小微企业的比例不低于60%。
