Article 1 These Provisions are developed in accordance with the Decision of the CPC Central Committee to Deepen the Institutional Reform of the Party and State and the Plan for Deepening the Institutional Reform of the Party and State deliberated and adopted at the Third Plenary Session of the 19th CPC Central Committee, and the State Council Institutional Reform Proposal | | 第一条 根据党的十九届三中全会审议通过的《中共中央关于深化党和国家机构改革的决定》、《深化党和国家机构改革方案》和第十三届全国人民代表大会第一次会议批准的《国务院机构改革方案》，制定本规定。 |
| Article 2 The Ministry of Civil Affairs is a component department of the State Council at the ministerial level. | | 第二条 民政部是国务院组成部门，为正部级。 |
| Article 3 The Ministry of Civil Affairs shall implement the guidelines, policies, decisions and arrangements of the CPC Central Committee on the civil affairs work, and adhere to and strengthen the Party's centralized and unified leadership of the civil affairs work during the performance of its functions. Its major functions are as follows: | | 第三条 民政部贯彻落实党中央关于民政工作的方针政策和决策部署，在履行职责过程中坚持和加强党对民政工作的集中统一领导。主要职责是： |
| (1) It shall draw up the draft laws and regulations, policies and plans on the development of civil undertakings, and develop departmental rules and standards and organize the implementation thereof. | | （一）拟订民政事业发展法律法规草案、政策、规划，制定部门规章和标准并组织实施。 |
| (2) It shall draw up the measures for the registration and supervisory administration of social groups, foundations, social service institutions and other social organizations, and organize the implementation thereof, and conduct the registration administration and law enforcement supervision of social organizations. | | （二）拟订社会团体、基金会、社会服务机构等社会组织登记和监督管理办法并组织实施，依法对社会组织进行登记管理和执法监督。 |
| (3) It shall draw up social assistance policies and standards, make overall planning for the establishment of the social assistance system, and take charge of providing minimum living security for urban and rural residents, giving assistance and support to people living in extreme poverty, providing temporary assistance, and providing assistance to indigent vagrants and beggars. | | （三）拟订社会救助政策、标准，统筹社会救助体系建设，负责城乡居民最低生活保障、特困人员救助供养、临时救助、生活无着流浪乞讨人员救助工作。 |
| (4) It shall draw up the policies on the self-governance and building by urban and rural grassroots and community governance, guide the building of the urban and rural community governance system and governance capabilities, offer suggestions on enhancing and improving the building of urban and rural grassroots regimes, and promote the development of grassroots democratic politics. | | （四）拟订城乡基层群众自治建设和社区治理政策，指导城乡社区治理体系和治理能力建设，提出加强和改进城乡基层政权建设的建议，推动基层民主政治建设。 |
| (5) It shall draw up the policies on and standards for the administration of administrative divisions and boundaries of administrative regions and the administration of place names; be responsible for examining the establishment, naming and changes of administrative divisions and the relocation of the seats of governments reported to the State Council for approval; organize and guide the demarcation and administration of boundary lines of administrative regions at the provincial and county levels; be responsible for the administration of place names; and be responsible for examining the naming and renaming of important natural geographical entities, international public domains and astronomical geographical entities. | | （五）拟订行政区划、行政区域界限管理和地名管理政策、标准，负责报国务院审批的行政区划设立、命名、变更和政府驻地迁移审核工作，组织、指导省县级行政区域界线的勘定和管理工作，负责地名管理工作，负责重要自然地理实体以及国际公有领域、天体地理实体的命名、更名审核工作。 |
| (6) It shall draw up marriage administration policies and organize the implementation thereof to promote the reform of marriage customs. | | （六）拟订婚姻管理政策并组织实施，推进婚俗改革。 |
| (7) It shall draw up funeral administration policies and service norms and organize the implementation thereof to boost funeral reform. | | （七）拟订殡葬管理政策、服务规范并组织实施，推进殡葬改革。 |
| (8) It shall promote in an overall manner, urge the direction of, and conduct supervisory administration of the elderly care services, draw up the general plans, policies, and standards for the building of the elderly care service system and organize the implementation thereof, and undertake the work concerning the public welfare for the elderly and the assistance to the elderly with special difficulties. | | （八）统筹推进、督促指导、监督管理养老服务工作，拟订养老服务体系建设规划、政策、标准并组织实施，承担老年人福利和特殊困难老年人救助工作。 |
| (9) It shall draw up policies on the protection of the rights and interests of disabled persons, and advance in an overall manner the building of disabled persons' welfare system and the development of the rehabilitation assistive devices industry. | | （九）拟订残疾人权益保护政策，统筹推进残疾人福利制度建设和康复辅助器具产业发展。 |
| (10) It shall draw up the policies on and standards for children's welfare, security for orphans and abandoned children, children adoption, and children assistance and protection, and improve the caring service system for rural left-behind children and the guarantee system for children in difficulty. | | （十）拟订儿童福利、孤弃儿童保障、儿童收养、儿童救助保护政策、标准，健全农村留守儿童关爱服务体系和困境儿童保障制度。 |
(11) It shall organize the drafting of the policies for promoting the development of charity undertakings, guide social donations, and be responsible for the administration of welfare lotteries.
