| As decided at the 14th session of the Standing Committee of the Twelfth National People's Congress, the prior approval provisions on industrial and commercial registration in the following laws shall be amended: | | 第十二届全国人民代表大会常务委员会第十四次会议决定，对下列法律中有关工商登记前置审批的规定作出修改： |
| I. The Electric Power Law of the People's Republic of China shall be amended as follows: | | 一、对《中华人民共和国电力法》作出修改 |
| In paragraph 3 of Article 25, “A power supply enterprise shall not begin operation until it has obtained upon application a business license from the administrative department of industry and commerce based on the Power Supply Permit” is deleted. | | 删去第二十五条第三款中的“供电营业机构持《供电营业许可证》向工商行政管理部门申请领取营业执照，方可营业。” |
| II. The Auction Law of the People's Republic of China shall be amended as follows: | | 二、对《中华人民共和国拍卖法》作出修改 |
| (1) Article 11 is amended to read: “To obtain a permit for engaging in the auction business, an auction enterprise must undergo the review and approval procedure with the department in charge of administering the auction industry of the people's government of the province, autonomous region, or municipality directly under the Central Government where the enterprise is located. An auction enterprise may be formed in a districted city.” | | （一）将第十一条修改为：“企业取得从事拍卖业务的许可必须经所在地的省、自治区、直辖市人民政府负责管理拍卖业的部门审核批准。拍卖企业可以在设区的市设立。” |
| (2) In Article 12, “To form an auction enterprise” is replaced with “To apply for a permit for engaging in the auction business, an auction enterprise.” | | （二）将第十二条中的“设立拍卖企业”修改为“企业申请取得从事拍卖业务的许可”。 |
(3) In Article 60, “forms an auction enterprise without permission and registration” is replaced with “engages in the auction business without a permit.”
