Earlier this month, the Ministry of Transport (MOT), the National Development and Reform Commission and the Ministry of Finance jointly issued the Notice of Further Regulating the Transfer of Rights and Interests in Toll Roads. The Notice makes it clear that the competent transport departments at all levels should effectively strengthen the supervision and administration of the transfer of rights and interests in toll roads, protect the investors' legitimate interests and the legitimate rights and interests of the public, revitalize the existing assets of turnpikes, and further maintain the market order of the transfer of rights and interests in toll roads. The Notice points out that the MOT should be in charge of the supervision and administration of the transfer of rights and interests in toll roads throughout the country, and should be responsible for guiding and supervising the daily supervision and administration of provincial transport departments. All provincial transport administrative departments should be responsible for the specific administration of the transfer of rights and interests in toll roads within their respective jurisdictions, and assume the primary responsibilities for the supervision and administration of the transfer of rights and interests in national highways. According to the Notice, for the highways that are built with funds raised by the competent transport departments of local governments at or above the county level, the transfer of the tolling right must be approved by relevant government departments, among which the transfer of the national highway tolling right must be approved by the MOT, while the transfer of the tolling right of roads other than national highways must be approved by the governments of provinces, autonomous regions and municipalities directly under the Central Government, and reported to the MOT for recordation.
