| Chapter I General Provisions | | 第一章 总则 |

| Article 1 These Measures are formulated in accordance with the provisionsof the Regulations of the People's Republic of China for the Security Protection of Computer Information Systems, Interim Provisions of the People's Republic of China on the Administration of the International Networking of Computer Information Networks and other laws and administrative regulations with a view to strengthening the security protection of the International networking of computer information networks and maintaining public order and social stability. | | 第一条 为了加强对计算机信息网络国际联网的安全保护，维护公共秩序和社会稳定，根据《中华人民共和国计算机信息系统安全保护条例》、《中华人民共和国计算机信息网络国际联网管理暂行规定》和其他法律、行政法规的规定，制定本办法。 |

| Article 2 These Measures shall be applicable to the security protectionadministration of the international networking of computer information networks within the territory of the People's Republic of China. | | 第二条 中华人民共和国境内的计算机信息网络国际联网安全保护管理，适用本办法。 |
| |
|
| Article 3 The agency of computer administration and supervision underthe Ministry of Public Security shall be responsible for the work ofsecurity protection administration of the international networking ofcomputer information networks. | | 第三条 公安部计算机管理监察机构负责计算机信息网络国际联网的安全保护管理工作。 |
Agencies of computer administration and supervision of public securityorgans should protect the public security of the international networking ofcomputer information networks and safeguard the legitimate rights and interests of units and individuals engaging in international networkingbusinesses and public interest. | |
公安机关计算机管理监察机构应当保护计算机信息网络国际联网的公共安全，维护从事国际联网业务的单位和个人的合法权益和公众利益。 |

| Article 4 No unit or individual shall use the international networkingto endanger state security, divulge state secrets, nor shall it/he/she infringe on national, social and collective interests and the legitimate rights and interests of citizens, nor shall it/he/she engage in illegal criminal activities. | | 第四条 任何单位和个人不得利用国际联网危害国家安全、泄露国家秘密，不得侵犯国家的、社会的、集体的利益和公民的合法权益，不得从事违法犯罪活动。 |

| Article 5 No unit or individual shall use the international networkingto produce, duplicate, search and disseminate the following information: | | 第五条 任何单位和个人不得利用国际联网制作、复制、查阅和传播下列信息： |
| |
|
| (1)information that instigates the resistance and disruption of theimplementation of the Constitution, laws and administrative regulations; | | （一）煽动抗拒、破坏宪法和法律、行政法规实施的； |
| |
|
| (2)information that instigates the subversion of the state politicalpower and overthrow of the socialist system; | | （二）煽动颠覆国家政权、推翻社会主义制度的； |
| |
|
| (3)information that instigates the splitting up of the country andsabotage of national unity; | | （三）煽动分裂国家、破坏国家统一的； |
| |
|
| (4)information that instigates hatred and discrimination among nationalities and sabotages solidarity among nationalities; | | （四）煽动民族仇恨、民族歧视，破坏民族团结的； |
| |
|
| (5)information that fabricates or distorts facts, spreads rumours anddisrupts social order; | | （五）捏造或者歪曲事实，散布谣言，扰乱社会秩序的； |
| |
|
| (6)information that propagates feudalistic superstitious, obscenity,pornographic, gambling, violence, murder and terror and instigates crimes; | | （六）宣扬封建迷信、淫秽、色情、赌博、暴力、凶杀、恐怖，教唆犯罪的； |
| |
|
| (7)information that openly insults others or fabricates facts to slanderothers; | | （七）公然侮辱他人或者捏造事实诽谤他人的； |
| |
|
| (8)information that damages the reputation of state organs; and | | （八）损害国家机关信誉的； |
| |
|
| (9)other information that violates the Constitution, laws and administrative regulations. | | （九）其他违反宪法和法律、行政法规的。 |
| |
|
| Article 6 No unit or individual shall engage in the following activitiesendangering the security of computer information networks: | | 第六条 |
| |
|
| (1)access to computer information networks or use of computer informationnetwork resources without permission; | | （一）未经允许，进入计算机信息网络或者使用计算机信息网络资源的； |
| |
|
| (2)deletion, revision or addition of computer information networkfunctions without permission; | | （二）未经允许，对计算机信息网络功能进行删除、修改或者增加的； |
| |
|
| (3)deletion, revision or addition of the data and applied procedures inmemory, processing or transmission in computer information networks withoutpermission; | | （三）未经允许，对计算机信息网络中存储、处理或者传输的数据和应用程序进行删除、修改或者增加的； |
| |
|
| (4)deliberate production and spread of computer viruses and otherdisruptive programs; | | （四）故意制作、传播计算机病毒等破坏性程序的； |
| |
|
| (5)other activities that endanger computer information network security. | | （五）其他危害计算机信息网络安全的。 |
| |
|
Article 7 Users' freedom of communication and communications secrecyare protected by law. No unit or individual shall use the internationalnetworking to infringe on users' freedom of communication and communications secrecy in violation of the provisions of law.
